It's not about filling positions. You're probably right that police agencies would find enough applicants to fill vacancies even if qualified immunity went away. Keep in mind that most are having difficulty finding enough qualified applicants at present.
One of the strongest arguments in favor of qualified immunity is that it facilitates discretionary decision-making by officers. Think about this - if some drunk walks up to you an the street an punches you out, do you really want the responding officer to say "Nope, I'm not going to arrest him. He could claim that it was mutual combat and then sue me."
Or do you want for your daughter to be molested, and the responding officer refuse to arrest the suspect because there "isn't enough proof" that the crime was committed.
Be careful what you ask for, you might get it."The right to keep and bear arms . . . is not the only constitutional right that has controversial public safety implications. -- Justice Alito, McDonald v. Chicago

I hate to be onerous, but could you expand a little on this for my edification? I've seen this point a few times and though I consider myself fairly well versed I California gun law, this one is a new one for me.

30 round magazines were good to go in featureless prior to July 1, 2017. Then it became illegal to own 30 round magazines.Comment

The real question is whether the 9th Circus issues a stay pending appeal. I wish I knew how to assess the odds of a stay being granted pending appeal.

ALL registered AW's can use any magazine you like.
The 10 round distinction is a DETERMINING FACTOR on if a fixed magazine semi-auto centerfire rifle is an assault weapon or not.
People stick to 10 round make to ensure that their fixed magazine semi-auto centerfire rifles are NOT an assault weapon.
Once a rifle IS registered as an assault weapon, you really don't need to worry about if your use of a magazine over 10 rounds ALSO makes it an assault weapon because it'a ALREADY an assault weapon.

What time period were you in where they issued ARs?Comment

I think they jerked around the definition of registered, not with what defines an AW, to make that happen. Liberal logic would say that changing the bullet button drastically changes what is actually being registered as if changing a gas cap would turn a car into an assault vehicle when registering with the DMV.
RAW and BBRAW may differ in terms of what is registered, but both are still AWs and a 30rd mag doesn't make them assault++ AWs.Last edited by HibikiR; 03-30-2019, 10:17 PM.Comment
