Just follow the directions in the email exactly when shipping it back to them.

Do not expect a confirmation of receipt.

They will send you an email when they have inspected it and approved your refund

Thank you for contacting EOTech. The refund amount that you are requesting is high. The MSRP for a model XPS2 in 2010 was $xxx.

Please update your refund amount or attach a receipt to support the refund amount. You can attach it to this existing email request and forward it back to us, so that we may proceed in reviewing your refund request.

In the Failure Description section I included the following statement:
Thermal zero shift concerns. Dollar amount listed included sales tax (CA).

I edited out the amount request, but it was 2010 MSRP + tax. Apparently, L3 isn't covering taxes paid to a LGS/CA. Understandable, but I wish they stated that on the form (or just subtracted tax) as I will resubmit with MSRP and wait another 10 or so days. Mental note to self, only buy online and out of state. Not bashing L3, just wish that had been a bit more clear on what they would/would not cover. Found out the long/hard way. Maybe I can save someone time by only referencing MSRP (or having their receipt).

On the downside, who keeps a receipt for a sight after 5-6 years? But on the upside, what company offers a MSRP refund on their product after 5-6 years. So I'll wait for the next round to see if they approve my resubmit. In any case, kudos to L3 for the offer.

          No one does this.

Why would you expect them to cover your Sales Tax?

I don't know many folks who even pay MSRP and I'm pretty sure that L3 knows that too. Their willingness to even cover an amount up to MSRP is pretty generous...especially for older purchases

Since you're the first person to complain that they wouldn't cover Sales Tax, I think we can pretty safely figure that most folks weren't that greedy.

Since there was no detail on what L3 would or would not cover, I disclosed what I paid (tax included). I didn't necessarily expect them to cover that, but since I noted it separately in the notes they could have just as easily subtracted it. Simple. Maybe a concept too hard for you to comprehend. Understandable as you only seem to want to focus on negative/greed. Nice.

As far as paying MSRP, couldn't touch an Eotech for under MSRP when I purchased it LOCALLY (show me a LGS, where we purchased this, that sells for under MSRP). Even today (MidwayUSA) MSRP discounts only average 5-7%. LGSes don't, and definitely didn't a few years ago, offer Internet pricing.

Ummm, I'm not complaining, simply noting what occurred. I believe I gave kudos to L3 a couple of times, so again, stop trying to read or place negative (or greed) into this.

They put a vague offer out there and I submitted a request in response. What happens is what happens and if you have issues with it that's apparently unfortunate for you.

The State of California has your tax money not EOTech so there actually should be some way to recover your sales tax from the state. Would it be worth the time to even find how to get it refunded, I doubt it. Would you need the receipt proving you paid the tax, yes. Proof of actual refund from EOTech also.

From tech point of view it is all logical that in precision mechanism built from different materials-it will be shift, it is clear and kosher. What about other manufacturers, they don't have that shift or they don't got caught? I would not believe any optics made by anybody will hold perfect zero sighted at -40 and then put +120 and it will be no shift. 7075 has expansion rate of 13.1 micro inches/1 degree Fahrenheit. Probably adjusting screws made of brass (9 micro inches/1F) or stainless steel (minimum 5.2 micro inches/1F), seems like any case dimensional change with temperature will be not significant and it is inside sight itself, but ones this dimensional change projected to MOA-start growing up crazy. I just don't see how other manufacturers have their design works differently. Unless internal adjusting mechanism made of Tungsten or some sort of Silicon Nitride ceramic, it must be shift. Now, beside different materials, let's say everything is made from the same material-it doesn't mean they will expend or shrink evenly. Longer parts expend/shrink more then shorter parts. That means some all part of sight will be changing mechanical dimensions at same rate, but in absolute value differently-this will drive shift as well. Probably theoretically it is possible to design parts for adjusting mechanism different length from different materials and try to compensate absolute value of expansion/shrinkage, but it is only theoretical, practically I think it is still will be shift. Up to now I was talking only about adjusting mechanism. To be fair, I need to mention optical architecture too. There are 2-3 mirrors placed pretty far appart and bonded to the housing. Chnging temperature of housing will displace mirrors positions ad well and definitely will contribute to shift. To design such precision tool-very big chalnge and it is fun for mechanical engineer. It is highely possible this design will never be perfect or nearly perfect due to the nature of it. I think EOTech engineers did a great job with what we have.
Bigger concern is electrical components, those are tricky, most of the components rated to -20C and for anything lower then that is already not ordinary over the counter components. Seems like EOTech doesn't have electronic failure, just mechanical shift.
Disclamer, everything I wrote is just my analyze and it is not official statement or point of view.
I think this issue is more mental then physical.
I am designing devices which are working in temperature range from -55C (at altitude 30000') up to 80C. Our requirements for mechanical tolerances are not that tight as it have to be on optics. We testing/qualifying or product to full Mils-Spec 810, RTCA DO160 and others.

And BTW, I got my RMA approved, and I am on the fence now to return it or to keep it. Really don't want to find out 6 month from now that other manufacturer admits their optics has similar shift (I am pretty sure now somebody will start digging) and all will start over.
And I appologise for my English, it is probably the best I can do on language field. LOL

I've had my RMA approved $530 before Christmas, I'm in no hurry to send it in,until I see that people have cashed their checks and have the $ in their hands.

I read this on the AR site this A.M.

"I spoke with a EoTech LE rep at SHOT yesterday and he said they are just swamped right now and are working as fast as they can to get the checks processed. Since they have never done this before it is taking them some time. No time frame was given. IIRC they hired a 3rd party to process the checks."

Just calculated what will be internal shift for 4 MOA. If we assume that adjusting mechanism is inside .5" box, to internal shift will be somewhere 0.00055556". This is considerably very precision piece mechanic with very high accuracy. Parts for one the most expensive Swiss watches Loiseau are made to tolerances of 0.0003937008".
                            Convincing?

The time for technical analysis has long gone.
People just want their money back to buy other optics that may or may not have the same issue.

I am not trying to convince anybody to keep or return their hardware. It was just thinking on loud. I am on the same boat as everybody else. As I stated earlier, I don't want to get disappointed again!
