    Only after July 1st, however the consensus is to just put the 5 things to avoid confusion (in case someone inspects who doesn't know the ins and outs of the law): S/N, Model, Cal, Name, City

      If you read through this thread, there is a general consensus, with some opinions from some very knowledgeable members, that it may be possibly illegal to manufacture/assemble a semi-automatic AR type pistol, after 12/31/16. Based on your aquired date, you're pretty much letting the DOJ know you did just that. Tread carefully.

        Gotcha. I have gone through theses threads a couple times now but its too hard to interpret this crap anymore. This all in theory if I did build one today let’s say. That being said...Is there a LEGAL way to build an AR Pistol in 2018? Or was 2016 the cut off?

          The same folks have opined that it may be best to build as a dimensionally compliant, single shot bolt action, and leaving it as such, "while lawyers do battle."Sent from my SAMSUNG-SM-G920A using Tapatalk

              I know it has been "discussed", but my reading of the requirement is than only a SN is actually specified/required. Doing all the other info may be "smart", but is it the law?

              And another probably dumb question...if the pistol lower is engraved with all the ATFE stuff, could it be sold/transferred as a fixed mag later due to such?

                I just wanted to double check and make sure that I parsed all the information in the forum correctly:

                If a person has an AR Pistol that was purchased via the SSE and equipped with a bullet button it is now considered an Assault Weapon under the new law. My understanding is that you have three options:

                1) Separate the lower from the upper and it will no longer be considered a semiautomatic weapon per section HH of Section 5471

                (hh) “Semiautomatic” means a firearm functionally able to fire a single cartridge, eject the empty case, and reload the chamber each time the trigger is pulled and released. Further, certain necessary mechanical parts that will allow a firearm to function in a semiautomatic nature must be present for a weapon to be deemed semiautomatic. A weapon clearly designed to be semiautomatic but lacking a firing pin, bolt carrier, gas tube, or some other crucial part of the firearm is not semiautomatic for purposes of Penal Code sections 30515, 30600, 30605(a), and 30900.
                (1) A mechanically whole semiautomatic firearm merely lacking ammunition and a proper magazine is a semiautomatic firearm.
                (2) A mechanically whole semiautomatic firearm disabled by a gun lock or other firearm safety device is a semiautomatic firearm. (All necessary parts are present, once the gun lock or firearm safety device is removed, and weapon can be loaded with a magazine and proper ammunition.)
                (3) With regards to an AR-15 style firearm, if a complete upper receiver and a complete lower receiver are completely detached from one another, but still in the possession or under the custody or control of the same person, the firearm is not a semiautomatic firearm.
                (4) A stripped AR-15 lower receiver, when sold at a California gun store, is not a semiautomatic firearm. (The action type, among other things, is undetermined.)
                It can never be reassembled unless it is taken out the of state or it is modified per option two.

                2) Replace the bullet button with an AR Maglock 2 or equalivant so it meets the definition of having a "fixed magazine" per section M and N of Section 5471

                (m) “Detachable magazine” means any ammunition feeding device that can be removed readily from the firearm without disassembly of the firearm action or use of a tool. A bullet or ammunition cartridge is considered a tool. An ammunition feeding device includes any belted or linked ammunition, but does not include clips, en bloc clips, or stripper clips that load cartridges into the magazine.
                An AR-15 style firearm that has a bullet-button style magazine release with a magnet left on the bullet-button constitutes a detachable magazine. An AR-15 style firearm lacking a magazine catch assembly (magazine catch, magazine catch spring and magazine release button) constitutes a detachable magazine. An AK-47 style firearm lacking a magazine catch assembly (magazine catch, spring and rivet/pin) constitutes a detachable magazine.
                (n) “Disassembly of the firearm action” means the fire control assembly is detached from the action in such a way that the action has been interrupted and will not function. For example, disassembling the action on a two part receiver, like that on an AR-15 style firearm, would require the rear take down pin to be removed, the upper receiver lifted upwards and away from the lower receiver using the front pivot pin as the fulcrum, before the magazine may be removed.
                Per Senate Bill 23 this would no longer meet the definition of an "Assault Weapon" Penal Code Section 12276.1 and could have an item such as a flash hider / suppressor.

                3) Register as an AW :-(

                  You are very perceptive, yes that was our understanding from reading both the original law and the rewritten "clarification" regulations that were adopted a few weeks ago. I think just to be on the safe side it's good to engrave per AFTER JULY 1st standards (with your unique serial). This is only to avoid questions and possible issues if someone from law enforcement is just looking for anything that appears out of place. I do believe the only engraving requirement for rifles made up till 7/1/2018 is your self-assigned unique identifier (serial), according to the law as defined.                       Looking to buy a fixed magazine AR pistol from a LEO. Local FFL will only do the PPT in stripped lower form. Will I be legal to put the upper back on the lower once the gun is in my name?

                        You can legally buy a pistol lower PPT, but don't even think about building it out with a bullet button. We've had a number of confiscations and at least one arrest because someone attempted to register a BBAW that the DOJ believed to have been transferred to them after Jan 1 2017.

                            My 80% AR pistol was completed before 2014 but I registered it as an AW just fine without volreg.

                              I have a 80% AR pistol built in 2016. I have already received and engraved FMBUS serial number from DOJ for BBAW registration. I mentioned to DOJ that it was a 2016 80% build for BBAW registration, and there was no issue obtaining serial number from DOJ. Plan was to do the BBAW registration but now it seems some are saying the legality of this is uncertain.

                              What are the considerations here?

                              If it's not safe, I guess I could just configure it with patriot lock and avoid AW registration?
