Unable to deliver guns

I called about a few Ammunition background checks last week and the nice lady told me they have no deadline to approve the ammunition background checks and I should inform my customers that they will be completed when they are completed.

My first one from the 18th of March was approved yesterday.
TRANSACTION DATE/TIME: 03/18/2020 11 : 56 : 22 AM
DECISION DATE/TIME:04/05/2020 10 : 28 : 44 AM

A right delayed is a right denied. I really hate it when people don't understand this. Maybe this can be used as additional ammo for why a 10-day wait is unconstitutional and have it thrown out. Ammo law can go right along with it.

I would suggest that anyone who was forced to make multiple trips file a claim. Even if they don't pay, they will have to deal with all the claims.

Looks like they are starting to fix them. I had a couple whose earliest delivery date was changed to 7 am this morning. They were up yesterday.

That is quite interesting. How and why are they changing the earliest and latest delivery date, especially with respect to the law. The waiting period is based on when the DROS is submitted, not when they actually do the background check. It seems like they like to play fast and lose with the law.

I referred a few customers to this thread letting them know it was a statewide issue being felt by many FFLs.

And did they clear at the 10 day mark, or a slight delay?

The PC for the standard or COE check is supposed to be "immediate". The Basic check has no prescribed timeline though.

Yea, the Standard Checks seem to be going through okay for me. I thought the Basics were supposed to be between 3-10 days.

I emailed DES and got the same canned BS response: "Thank you for your patience. Due to the high volume of transactions, we are experiencing a delay. Please continue to check on the status. If the status does not change within the next 24 hours, email us back and let us know." It has already been 24 hours!

So with that being said and per the ATF Open Letter to ALL CA FFLs can we legally proceed with transferring the firearm to the customer? Not that I will until I get an Approved DROS but just curious. See attached link.

Doubtful..keep in mind until we click "Deliver" CA DOJ has not recorded that the customer "owns" the firearm. Which means they would leave your premises with an unregistered firearm as far as any LEO would be concerned.

Then you have the issue what if it comes back delayed (such as 1 of mine did today).. Then you've released a firearm that was on delay too soon.

It's all bad news for us.

I wasn't able to pickup yesterday in Livermore, others were waiting since about noon. My initial DROS was 3/25 4:28pm. Was wondering if this was an isolated to that FFL or state wide issue. Hopefully by tomorrow this will be resolved and get to drive 40 minutes to and from again.

Just got a call from my FFL in Livermore, my DROS cleared and is ready for pickup. Hope that there's no traffic going there after work.
