Hey guys I have a question.

3/27 transaction date around 11:45am. Should I even bother going? I’m asking now because the shop I’m picking up at is 2 hours away.

Maybe I’ll just go down there, get denied, and call FPC as a plaintiff?

How about you call before you go and find out if they are going to release it to you? If that's right at the 240 hours though they won't know until your time comes up whether or not they hit the jackpot or the wammy.

Under Penal Code section 28220(f)(4), the Department of Justice (DOJ) has up to 30 days to complete background checks on purchasers of firearms and ammunition. Prior to the COVID-19 pandemic, DOJ typically completed these checks within Penal Code Section 26815(a)'s 10-day waiting period. COVID-19 protective measures have impacted the ability to increase the personnel resources in the DROS unit to address the recent sustained increase in firearms and ammunitions transactions without compromising the health and safety of our employees and the community. As a result, firearms and ammunition dealers and purchasers should know that as DOJ employees continue to perform the statutorily required background checks throughout the COVID-19 pandemic, circumstances may compel that background checks are completed after the expiration of the 10-day waiting period. DOJ will continue to strive to provide the best service and complete these checks in the shortest time possible.

So the 10 day wait is just an arbitrary number, and in reality, is a favor to us as opposed to the allotted 30 days? I didn’t realize the 10 day wait was only a minimum.

The waiting period was originally intended as a "cooling off" period and it is not an indicator for how long it takes to perform a background check.
^Example... In 1923, when the 1 day waiting period went into effect, there was no background check requirement.

In 1996, the CA legislature passed a bill that reduced the waiting period from 15 days to 10 days and required the CA DOJ to update technology/regulations to allow CA FFL dealers the ability to send DROS info electronically, instead of by mail.

Say what? The info listed on the DES claims that the CA DOJ has 30 days to complete a background check based on 28220(f)(4):

(f) (1) (A) The department shall immediately notify the dealer to delay the transfer of the firearm to the purchaser if the records of the department, or the records available to the department in the National Instant Criminal Background Check System, indicate one of the following:

But they are failing to notify dealers of the the delay. In addition, it sales "if the records of the department, or the records available to the department in the National Instant Criminal Background Check System, indicate one of the following", but there are no records which indicate one of the following since they end up approving the person.

So how exactly legally are they claiming that they have 30 days when there are no records to indicate that there might be a problem, it is just that they are not getting around to dealing with it.

It seems like they are throwing crap out and hoping it sticks to the wall and people accept what they are saying as being valid, but it doesn't seem to be the case.

Something else I noticed. The "LATEST DELIVERY DATE" on DROSs will be adjusted to when CA DOJ actually gives us the Approval + 20 days. This means that if you attempt to purchase a handgun 31 or 32 days after you started your last DROS you will likely get a 1-30 day rejection even though it's 1-32 or 1-34 days, etc..

That would be quite interesting since the law is about submitting and if they reject it when it has been over 30 days, they could have a problem, but I seriously doubt that they care.

I believe the DOJ must first issue an undetermined notice. That to my knowlege has not been done. They leave the DROS as PENDING. Also they bump up the initial DROS date. Are they starting their 30 days from the new date?
