The other is, AN EVEN BIGGER FINGER IN THE FACE OF THE FFL.

You can "SUE THE BASTARD". For an obvious arbitrary, BREACH OF CONTRACT.

Since it was the FFL who CHOSE to BREAK THE CONTRACT. The FFL has no legal right to with hold ANY OF THE PROCEEDS of the contract they broke.

They will of course try and confuse and obsfucate the root issue here. They will claim that the DROS fee is NON REFUNDABLE. But that is their problem. NOT YOURS. Because they chose to break the contract. Not you.
Well, I didn't use a Credit Card so it's a refund less the fees, as far as suing it's easy to say but time-consuming and costly the middle finger is always an option.

Time consuming, I can agree with.

But "costly", not so much, unless you include lost wages for the appearance. And even that cost is matched by forcing the FFL into court with you. As part of the BIG FINGER.

      https://www.dca.ca.gov/publications/...n%20%245%2C000.

The fee for filing in small claims court depends on the amount of the claim: $30 if the claim is for $1,500 or less, $50 if the claim is for more than $1,500 but less than or equal to $5,000, or $75 if the claim is for more than $5,000.
Actual filing cost is a ratio of 3 Small Claims Cases. Equals 2 DROS's.

One member, IIRC in this thread, was getting screwed to the tune of $300 for "non existent re-stocking fee".

I read that if they come up with a bogus fee like that I will have my day in court.

Do you mean a "bogus fee", or a bogus fee that large?

Because IF your FFL choses to cancel the DROS. They themselves just turned all of the $47, DROS FEE, BOGUS. Don't forget the $10 they keep out of that.

They can't "legally" charge you a STATE MANDATED FEE. Then CANCEL the DROS, and NOT REFUND the STATE FEE. Without the STATE MANDATING THEY DO SO. An undetermined status, includes no such state mandate.

FFLs are OK by NOT refunding a DROS fee. ONLY if it is because the buyer FAILED the DROS and was denied. That is no fault of the FFL's.

As to the member that got stung by a unscrupulous FFL for $300 re-stock fee.

              It was post #210

Update to my first Dros delay went in to pick still showed delayed called back 2 hours later and it showed it could be delivered but it was undetermined the second Dros 30 days will be up July 1st at a shop that does not release on undetermined and they want a 25% restocking fee on 1200$ what should I do?
WHY DO UNSCUPULOUS FFL'S CONTINUE WITH THIS ILLEGAL POLICY?

QUITE SIMPLY ............... BECAUSE THEY CONTINUE TO GET AWAY WITH IT.

Afactor; THEY LIED. They have direct communication with DOJ through their computer system {DES}.

You ever see a PM or Email, that didn't have a "header" on each reply? They know right down to the minute when you were approved.

They just wanted to deflect your ire at the DOJ, rather than own their incompetence.

So, I just got off the phone with the Bass Pro Shops in Rancho Cucamonga and asked them what's up I gave him the DROS number the guy said no change. So 07/19/22 is the final day so I asked what they do with a delay or undetermined. He said their policy is to wait until the final day and I have the option for a refund or pay the DROS once again and see what happens he told me to call the Doj myself he says they will not call the DOJ they wait for a letter via snail mail.

So bottom line is that BP is gonna SCREW YOU on the 19th. Or maybe you will invite them to SCREW YOU again, 30 days past the 19th.

Either way they're gonna SCREW YOU! The "undetermined" snail mail letter. Takes so long to reach an FFL. That they must re-DROS. Because the Fed NICS BG number is only good for 30 days. From the time Ca DOJ requested the Fed BG check. And Feds replied with the number.

Please refer back to posts #199-202-278. For explanation. Member "taperxz" is a very knowledgeable Central Cal FFL, and long time CG member, that delivers on undetermined.

In furtherance of earlier SUE THE BASTARD discussion. With an outfit like BP. That proverbial FINGER in their FACE. Gets exponentially LARGER.

ONLY certain employees of FFLs are ALLOWED to sell guns/ammo. IIRC [someone correct me if wrong] THOSE employees must have a current COE, and then there is the FSC issue. Must be certified by state to give FSC test and issue card.

A small claims filing allows you to subpoena those employees as witnesses. And unlike Superior Court filings, even you can serve SCC subpoenas.

THAT gives you the legal ability to SHUT DOWN BP's gun/ammo sales for a day. HOW MUCH does that affect THEIR BOTTOM LINE?

2Azone is in Upland, and not far from Rancho Cucamonga.

I've never been there. But there is MUCH good said about them on CG. And so far, NOTHING bad.

Right on target pacrat. They're a good place to dros a firearm. I've been there probably 15x in the last 8-9 months and there's always a line and always 4-6 people drosing guns and it's happening all day long.

Your best bet is to make a appointment. They're usually running a little behind but it's better then waiting in line
It takes a lot of balls to play golf the way I do.

Especially standing in line just to be SCREWED by a business that relies on customers just like you to stay in business.

If they aren't an HONEST BUSINESS, they don't deserve the patronage of HONEST CITIZENS.
