That would be a gray area. No additional fees can be charged during the waiting period, but the waiting period is 10 days. This is a delay in approval which exceeds the waiting period. The CA DOJ would need to rule on that to really know and that could go either way.
Is the FFL saying that they are going to charge? While there is chance that they could, it really seems like it would be a bad idea to do so when the firearms can't be delivered.
