No I'm not getting banned for this joker. I'm hoping it doesn't come to this, but I'm not going to wait around like those mosin group buy suckers. If I don't receive the upper (not a refund) by Wednesday, I'm taking him to small claims court and filing a police report with the San Diego sherriff's department. That will have given him 14 days from the time he received my money, to deliver the good.

I don't understand why you want to go thru small claims, so much time and hassles. You paid thru PayPal, deal with them first, you have 60 days to file a dispute and escalated to a claim, this would be your easiest route to take at this time. If the paypal payment is marked as a service with no specific note on what the transaction is for, that makes it harder on your side. If the transaction is marked with a note stating exactly what it's for, but no tracking # nor delivered date, you are at the advantage and should be able to get your money back easily.

Just because you paid an xx amount and the item is worth xx amount new, even thru small claims, you will only get what you paid and not the extra amount of what it would cost you to buy a new one.

My understanding of Paypal policy is that even if it was a "non" gift transaction, then the fact that is firearms related would get you suspended anyhow. Please correct me if I'm wrong. But if this is the case, then why give this non 2A supporter(PayPal) money?

I've personally never had a problem with any transactions, but maybe its it's time we all started using a 2A friendly payment services like pistolpay? Which is backed by the founder of Rainer Arms.

Yes, if specifying as a gift, buyer is screwed and cannot file a dispute with PP, live and learn. However, you can try filing an "item not received" directly with the credit card company though and they usually give you 60 days to do so.

According to PP policy, the seller is responsible for selling firearms(which is against PP policy), the buyer is not. Even if the buyer paid for a complete firearm, he/she is not violating their policy, the main thing is that is the item received or not.

As far as I can tell and was told by PP, they are not anti gun, the main issue is that there are just too many domestic and international laws to follow, hence the following policies from their site

Last year I sent this seller over $900 for a stock. I had ZERO issues other than waiting a couple days. I wouldn't have a problem buying anything from Jaefern again.
