"Brother in law" or in this instance "Bro in Law" is probably his broke alter ego.
Another thread was about his girl being pregnant. Maybe the baby came and he is broke. Or. Brother in law gave him cash for the upper. So now Mr. Fernandez has no money. No upper. And a new baby with a pissed off wife.
    Hmmm. Stuff like that.
    I'd Walter Solbchak his azzzz.
    This is not Nam dude.

OP iI have a strong feeling that you will not be able to get your upper by the way he keeps throwing those reasons out, a simple transaction gone rogue courtesy of this seller. I feel for you and hopefully you get your money back.

          ^^ Good catch SoCalPI,
This is the seller's mode of operation praying on people who fall for "I got family problems" trick.

One with family problems need to get his sh11T straight first before buying and selling guns.

Wonder if he sold the lower and the optics, according to this the gun/upper appeared to be back in San Diego at the end of last month.

Granted after a few days is understand but, some guys do go hog wild and need to relax. If the deal goes sour there are a few ways to get your money back and better ways of handeling things. People skills and patients goes a LONG way.

Second next time PM the mods and try to have it fixed internally than bash the guy publically right off the bat. We had a thread or 2 here of a smith and another shop which were torn apart by impatient people to later find out they had serious health issues and major life/family issues. And that guys couldn't wait a few weeks cause they wanted it now and basically almost ruined their business because they did have patients and a misunderstanding.

That said, with Kes's responce and the time passed, this may be interesting.

Either way I hope OP gets his upper. All ends well. Everyone is happy and we move on. Some guys need to learn some patients. After a week sure granted. But a few days? Come on. Sometimes it has taken me 2 days to find a box big enough to fit the items listed but not too big to jump the price x2 for shipping method.
Granted, but if you took the 30 seconds to respond to the email/text, he'd get off your *****. Being respectful and relatively responsive - when holding onto other people's money - is just common courtesy.

You'd expect more from someone who's been on CG a long time. Newcomer - yeah, maybe he gets a pass for being a douche before he gets straightened out. Old timer - not as much leeway.

Quick text of 'family problems, it could be a week or so until I can focus on this. Let me know if you want your money back' or 'Got the cash - looking for suitable shipping box - will confirm shipment' isn't too much to ask, if holding onto $500 of someone's money. But YMMV

                this.

Also I forgot to mention another little funny part about this whole story. When I initially said "I'll take it" and private messaged him asking where to send payment, he actually told me that he would need payment promptly if I wanted the upper as he had several interested buyers. So yeah, the gall of him to tell me that I had to pay him immediately and then he pulls this is just shows lack of class.I know I'm not "entitled" to anything more than what I paid him. And I have never asked him to give me anything more than what I paid him, just what I paid him for.

SELLER probably realized he listed the upper too low and found another buyer who already did pay more for it (which is why he doesn't have it anymore), and is also why he has no problem offering a full refund to which the OP paid for already.
Wouldn't be the first time in the market place. I've been shafted a few times. One time even left waiting at a LGS from crap like this. But at least that seller gave me an option to enter a bidding war via text while at the LGS waiting for him

There is no brother in law. Whatever the reason is, the seller is solely responsible for getting your item to you. If he was a stand-up guy and something did happen such that he could not deliver as promised, he should offer a refund plus $50 for the trouble on a transaction of this value. That's what I would offer if I f'd up and couldn't deliver.

No need, but thank you for the heads up.

No reason for anyone else to find trouble because of this bad situation. Posting his phone number was not the best idea.

This, regardless of the situation, posting the guys phone number is a major bonehead move
