I understand the basics of sales, perhaps more than you do if you think that you automatically deserve a refund if the seller did not commit fraud. A private sales is considered as-is and there are no automatic refunds.

Until the seller sells the firearm again, there can be no refund unless he feels kind since there is no idea of what the loss will be due to the buyer not being able to complete the transfer, for reasons that he was aware of in advance and due to that, he wasted the seller's time and money.

How do you seriously think that a seller is under some obligation to take out a loan or something to pay a criminal back when it was he who isn't meeting his end of the deal?

Basically i would say. "I already spent the money so i can't give you a refund, i'm not willing to break the law. I'll hang on to it for you till you get your background cleared up"

Do not transfer without a background check, do not use another buyer as a straw purchase. Just hold it till he clears his record.... probably never. However if he does get it fixed in a couple months i would probably do the nice thing and retransfer to him.

If he whines and complains just say, "Well maybe i'm being unfair. We should get a 3rd party opinion, lets ask that police officer over there what he would do".

Has it been sold yet? What time and effort was required to sell it? Without the details, it is hard to say what it is worth. Did the firearm come back the same as it was given to the FFL?

I agree that some money should be returned, but then again the OP said that the only contact he has for the person is no longer valid and that the buyer has left the state, so then what do you thing should be done?
