Yes, by default. Unless the seller agrees to a possible refund, there are no refunds. If you think otherwise, please show me where a private sale is subject to a refund and that should be in writing.

Since the seller in this case is a private party, the no refund notification would not be required.

Go buy something from a private party and try to demand a refund, then sue in small claims court that the seller did not give you a refund and see how far you get.

Fact or fiction in this case - I know several people that would fail a background check due to a felony conviction in their late teens (along the lines of a DUI that caused someone serious injury). Neither would intentionally cause someone harm (now or then) but they do have to live with their mistakes (until they can get their records expunged).

I'd say it is improper to stiff a guy on return of the money just because of a failed DROS. Now if he called me up and asked me to file off the serial numbers... I'd inform him his money would be waiting for him at the local PD.

I understand the basics of sales, perhaps more than you do if you think that you automatically deserve a refund if the seller did not commit fraud. A private sales is considered as-is and there are no automatic refunds.

Until the seller sells the firearm again, there can be no refund unless he feels kind since there is no idea of what the loss will be due to the buyer not being able to complete the transfer, for reasons that he was aware of in advance and due to that, he wasted the seller's time and money.
