    Question on a failed background check **update post 136**

    So I was selling a pistol to a guy I met via craigslist (ya ya I know) the guy paid me the amount in full but he failed the background check, now what? Does the pistol come back to me? Do I refund him? I've never had this happen.

    I "might" refund his money minus a small fee. But you don't have to. Course, if he has a copy of the paperwork he might have your home address...

      Well according to the local gunshop we did it at he is a felon.
      Does the gun come back to me after I re-register it?

          LGS will return the gun to you, no re-register provided you are not a felon. If seller and buyer are felon, LGS will give gun local law enforcement department.

                Yes, the gun comes back to you. You might have to go thru a background check yourself, before it gets released to you though. If so, I would at a minimum, deduct any out of pocket costs you incur before refunding the ex-buyers money.

                  As I understand it, you now get to keep both the money and the gun. The gun store will contact you and return the gun to you, the transfer to the buyer never did happen and you're still the registered owner.

                  The buyer might have your address, but he also knows you have guns. Tell him to go pound sand and for wasting your time. What? Did he "forgot" that he committed a felony?

                      I'd give him a portion of his money back, but I'd keep some of it as a nuisance tax. If it was a $600 sale, I'd probably keep $100.

                        He said it happened as a minor and thought it was off his record. Oh well more money for me. He called me just a little while ago and asked me to file the serial # off and give it to him and he would double the price. I told him to kiss my ***. Told him id give him $20 back for gas as well as the dros fee and the rest is mine. He just hung up. So I guess I'm keeping all of it lol. He wants to try somthing stupid he will have the wrong address. I moved recently so my address has changed lol.

                          Wow cool he actually wanted you to commit a couple of felonies to give him a gun. And you were nice enough to offer to refund part of his money, your a lot nicer than I would have been. Seems like you can meet the nicest people on Craigslist.
