False, a couple of my friends and I were able to place orders directly from the Brownells site.

That must have just started. I successfully placed an order around 1:00 and already got a confirmation email/number.

Yup-per. And if the CA-DoJ delays filing an application for a stay, the question of why did you delay if it was so important, would seem to be top of mind.

If major retailers are shipping, and if there's no announcement from the DoJ, I think they are not going to appeal this. It would be insane for them to do it, as they are taking a huge risk of creating a bigger precedent and a circuit split and a loss at SCOTUS. We're not seeing any announcements like "we're going to fight this all the way" or anything. They had to have made their decision by now and would be announcing something if they were going to fight. One reason they should have made their decision by now is that they probably made it even before the ruling was announced. They knew there was a high chance of this outcome and had to have planned for it.

Agree. Floodgates are open in California.

We will know the answer very soon. I think they need a stay this week for it to mean anything.

This decision only overturned the pertinent state law as unconstitutional. Any city ordinances are still in effect--though this decision could be helpful in challenging such ordinances.

However, the Sunnyvale ordinance has already survived a challenge. There may be a legal argument that a local ordinance is more appropriately tailored (and therefore permissible), even while a broad statewide law is not appropriately tailored (and therefore impermissible).
