There is no possible way you are a second year law student "specializing" in anything (which, just so you know, second year law students don't do). A trained seal could have answered the question you asked about contracts law in your initial post. A second year law student never would have asked it.

When new people post for the first time with questions about regular capacity mags or buying a gun on the internet or how much ammo we have in our stash, or generally seem to be doing research for an article, etc... people tend to get suspicious.

In law school, after you take your first year required BAR courses, you begin to take elective courses that you believe will help you specialize in a niche legal field. For example, my friend is planning on specializing in IP Law. He took IP classes and Corporate classes I will never take.

Okay, if you choose to characterize your choice of electives as "specializing" as you wish. Nonetheless, Contracts is a first year course, so your answer would have been there anyway.

And since we're talking about a $500 transaction (+/-) where your damages recoverable for breach, basically any additional cost to "cover", i. e., buy the gun from another source, would be less than $100.00, even if you did have a theoretical claim it wouldn't be worth pursuing.

Brownells i awesome. Earlier this year I was traveling from TN to CA then to CO and I had them ship a tool ahead to CO. When I got there for some reason the chamber reamer I had ordered had turned into a Glock front sight tool. Called Brownells, they checked my order and info, apologized for the mistake, and shipped me the correct tool overnight and told me to keep the Glock sight tool. Easy peasy. Never had a single real complaint about them (or Midway for that matter).

The other day I was rummaging around in one of my bins and came across a LH thread die that I had bought from them about seven years ago and never used.

The three remedies of breach depend on the theory of obligation: Expectation damages, Reliance damages, and Restitution damages. Restitution will most likely not apply since they were not unjustly enriched. The question lies in Expectation and Reliance damages. Specifically I would seek injunctive relief and not specific performance since the Glock is not unique.

You see counselor, we came up with different answers. The trier of fact decides what the answer is. I still haven't heard Mayor McRifle's answer or the so called navy seal answer. But I'm not looking to troll.

In layman's terms, ship the damn good. But again, I just asked what your guys is feedback is. I don't plan on pursuing this in court, which I very well can.

Hi-First time posting and new member. I purchased a brand new Glock 19 G3 from the Brownells website a few days ago. I used a promo code and the total price came out to $459 shipped. However, the gun includes (2) 15 round magazines. I called Brownells customer service and asked if they can swap those magazines out for 10 round magazines. The lady got back to me and said they cannot ship the gun because they have no way of contacting the shipping department and telling them to take the 15 round magazines out of the package.

From my understanding, if a gun is shipped to a CA FFL with any magazines over 10 rounds, the FFL will keep it.

My questiono I have an enforceable Contract with Brownells, since there wasn't a disclaimer stating the company cannot ship this item to CA?

I think that's absurd that one department can't contact another...specially from an awesome company like Brownells. I think they can and she's just being lazy to call someone else to intercept the package and remove a couple magazines. If not, just send me the standard cap mags and I won't complain!

I really appreciate the comments and warm welcome gentlemen. I didn't expect this much feedback but I did learn a few things. I forgot to mention that in the promo I was supposed to get a $25 gift card as well. That, coupled with a $20 transfer fee and $25 DROS, I thought the math made sense. Before the purchase, my FFL assured me he would block the mags so I thought no problem.
