Asking over and over if the price is right only means he was trying to prevent this very situation, NOT that he was trying to get over on Turner's.
Like drifts1 said - he's not getting it "for free". He's getting it at the price he was told to pay, the stated price.

This fact AND for the fact that it was the lower price that sold him on the purchase. He even said up front he was indifferent and noncommittal to buying one until she implored several times that the price she was giving him was indeed the price. So he jumped at the bait.

Ironically.... this thread alone - with as many gun owning consumers chiming in to see what will be the result - should be reason enough for Turners to honor the deal. Say it was a mistake, yes, that it was not the correct price - sure - but honor it. They have more to lose here from just the number of people having read this thread that the difference on what they sold this single firearm.

And another point: it was the correct price when they sold it, as noted, but only become a "mistake" long after the fact.

    Honor it.

turners needs to make good on this. their best course of action would be to honor the original deal. second option (but much less desireable as it still makes them look very bad) would be to refund every penny you paid including DROS. this second option still makes them look bad, and doesn't compensate you for your time and trouble doing the paperwork, driving back to the store 10 days later, etc...

they can't force you to pay $300 more or not give you the free gun, when you clearly "paid in full" upfront. they should just eat the $300 and use this as a learning experience. they should train their temp help better, or put adequate protections in place to stop this from happening again - program their computers to not allow a discount code to be applied to items already on sale, or require a manager override on discounts exceeding a certain amount.

Everyone jumps on saying he should get a FREE gun because of a MISTAKE. You have never made a mistake??
Do you guys understand that a company has the make a certain profit and if they do not by giving away FREE guns because of a mistake they will just raise prices in order to make there profit???? In the end YOU will be paying for it.
I worked in retail at a sport authority for a few years. Every sunday I worked the early shift to remove the old sale tags and replace them with new ones. Well one day I had to do both my department (footwear) and the Outdoors department because someone called in sick. I wasn't familiar with that department at all at this point.

Well in my rush of trying to do twice my usual work in the same ammount of time I accidentally put a sale tag on a 1500 dollar work out machine that marked it down to like 800 bucks or something.

Well sure enough someone jumped on the deal and bought the machine. She even brought the tag up to my register. Well it didn't ring up right (obviously) and I had to call a manager. Together we figured out what I screwed up.

He gave the lady the discount price without a second thought. She left happy, I got chewed out (luckily he wasn't to hard on me because he knew I wasn't familiar with that department) and the lady came back several times to buy more stuff and the store probably ended up making all its money back plus some with her.

I learned a lesson in customer service because of that.

Store should just honor the price, and eat the 300 bucks.

In the real world there are consequences for mistakes. If I made a mistake in my business, I fully expect to face the consequences of that mistake even monetarily. A good businessman will learn from that and also be successful enough to absorb the costs of that error.

Stores are not legally obligated to sell mismarked products. Courts have ruled that people cannot receive a "windfall" from the store employee's error.

That is different from if the sale was completed already.

The interesting issue to me is that Turner's get's a second bite at the apple because of the 10 day waiting period. If this happened with a pair of shoes, you would have paid and gone home with product in hand, case closed.

I wasn't saying anything about legalities of Turners. I don't care what they LEGALLY should do.

I was talking about morality. I messed up. I represented the business, so my manager decided to turn my potential blight on our reputation (by being incompetent) into a good thing. Instead of the customer leaving going "forget that company they hire a bunch of dumbasses" she left going, "Wow! they gave me such a good deal!!! I'm going back there for all my workout products!"

My manager COULD have told the lady to pound sand. But he decided he valued her long term business over the 700 dollars of short term loss of profit.

The way Turners handled the situation speaks a whole lot about their character, and customer relations. Hopefully corporate will accommodate the OP

If I was the manager I would have just ate the loss rather than possibly lose someone willing to spend 700 dollars at my store. Then I would have chewed out / wrote up / re-trained the employee on correct policies

It's not your problem the employee was not properly trained. You probably would not have made the purchase without the special (if erroneous) offer.

Businesses, like mine and like Turners, make mistakes all the time. When we make a mistake, we accept the requirement to make it right.

If I was the manager I would let the deal go through without a second thought. In fact, I'd probably have a few strong words for the second salesperson, suggesting that she can't expect customers to pay for the mistakes of other employees.
Mitch should have typed /thread after his post

alot of great responses, i'm pleased to see the overwhelming majority in my favor.

Again, I'm not looking for any freebies or handouts here. I left the store with the BFC15 feeling uneasy about what just occurred and over the course of the next few days it all just didn't sit right with me. That's when I contacted Rob. I'm just looking to recover what was originally promised to me, the deal that I bit on due to it being an exceptional deal.

Tonight I'll pull up my receipts and paperwork and comb through them carefully before I make any phone calls.

Are you kidding me with this? I didn't walk in there for this deal, they triggered my response by offering it to me. I confirmed the validity of the deal with the salesperson, who, mind you, *turned the computer monitor around to face me* and showed me the price. I agreed that it was a great deal, so I pulled the trigger. I had my girlfriend with me who can confirm every word of this.

Nowhere did I ask or expect something for free. I expect what was promised to me, what I payed for, what we agreed upon.

                              Unbelievable.

I don't see how Turner's has any wiggle room at this point to not honor the sale. As stated, the only reason they can try this at this point is because of the 10-day wait.

But legally, the OP owned that gun as soon as the transaction was completed. The fact that CA law does not allow him to take immediate possession does not change that fact the he legally owns in.

Yea, someone screwed up, but the OP also asked repeatedly if the price was correct, so it's not like he knew someone was making a mistake and just kept quiet. He completed the transaction in good faith and has a receipt to prove it. Turners is screwed on this deal and they need to hand over his merchandise.
