That said I am curious, do you disarm [sic] and lock it up while driving? A am somewhat shamed to admit that I do not 'definately' know the legality of having the pistol not locked up in the car.

I, too, cannot get my head around "car carry." I think the law that states one should keep their firearm in a locked container, separate from ammo, only applies to concealed, i.e. out of plain sight, in a bag (thus a catch 22). As long as there is not a round "capable of being fired" attached to the gun, it is OK to keep carrying in the car? So I imagine the glove compartment would be considered "concealed"...?

Would someone kindly address this?

my understanding of it is that in the car, you can carry open as long as it is not concealed in anyway. I.e. on your lap, unloaded.

Should you drive for a school zone, however, it needs to be placed in a locked container, which opens some questions regarding how to legal transition from carrying open to concealing it legal in the vehicle.

4thSeal, your story definetly had an impact on me. While I am only 20 years old and cannot purchase a handgun I look forward to open carrying my first handgun out of a store. I got my rifle laws down, now I need to get cracking on open carrying handgun laws. (Hopefully I can convince my parents to transfer me one )

Sounds like you handled yourself very well. I would keep in touch with the watch commander, get that meeting with the chief of police, and maybe even carry a letter from one of those men I just mentioned or from an attorney.

And by the way everyone thanks for the support... I almost stopped carrying. Your comments really helped. Hope everyone will do what they can do to support our rights and promote freedom and our constitution.

I tried to call the DA's office here in manteca, the lady that awnsered the phone said we cannot give out legal advice and I explained the situation/story asked if there was a way to speak to the DA and she said no. Recommended i google case law or consult a private lawyer. She was pleasent and didnt seem shocked about what happened. She said unless there is a citation or case number or something PD sent them review that wasnt of their concern.

I believe that is commonly referred to as a "circle jerk." Police "talk to the DA" DA "we won't do anything except for the police." Your tax dollars efficiently at work. I think Arnie's only bright idea to date is to shut down a bunch of this state - it is wasting money at a phenomonal rate.

Wow. All these offers of beer and appreciation seem to be overflowing. Perhaps instead of pats on the back and 'atta' boys, there ought to be a deeper, more meaningful show of support.

I have heard that imitation is the highest form of flattery. Instead of these gestures, maybe some of you can build on the work that CA_Libertarian, FreshTapCoke, myself and now 4thSeal have done in showing that even when police contact occurs, arrest is not likely during peacable open carry.

I would recommend taking some time to become familiar with the pertinent code- doing some homework in your own community by finding out what city and county ordinances may effect either possession or discharge of firearms. This information can be consolodated either here, or over on opencarry.org so that others can benefit from the work you have done.

Once you have established confidence in the legality of what you are doing, support in deeds what you admire in word. In addition to MudCamper's pamphlet or other 'cheat sheet' you will need a digital or tape recorder for documentation, and bringing a friend along for the experience wouldnt hurt. This has already been occuring in Redding, Turlock, Santa Clarita, Los Angeles, and now Manteca- let's start taking back California one community at a time. With exposure comes tolerance... and with this we can change the perception that only police and criminals own or carry firearms.

I like two things.

First, how the 2nd and 3rd cops on the scene were happy to waste tax dollars by arresting someone because they weren't sure if they'd committed a crime. Thanks boys, that's just what the DA needs.. more cases to deal with.

Second, I love how the LT. from Manteca keeps throwing questions back at 4th Seal. Sure, we all say or do things we regret but we're not cops and we're not going to be denying people their freedoms by making those mistakes.

A cop needs to be more careful than you and I for that very reason.

So I've been a lurker here for a while, but I wanted to post and say that I really respect your courageous actions! I'm planning on getting my first gun this summer, and will be doing my own local research about open carry. I suspect there are a multitude of ordinances regulating OC in Oakland, but I won't know till I check. Thanks again for standing up for our rights!
