I couldn't keep quiet. Civilians dislikes non-civilians (military, LE, etc) being able to do something or have something that they haven't afforded the privilege of having or doing. Military people just read the law as it is written not as civilians want to interpret it for you. If you get a signed letter with the letter head UNITED STATES "_____" Branch of service, military address, date top right under letter head and branch logos stating you are authorized to purchase the gun in the discharge of your official duties, and signed by an authorized authority in your command you may purchase the gun. Military is sworn just like the others are sworn so don't let that throw you off. PC830. pertains to carry of guns by LEO "We" (military, LE) were all sworn to uphold the constitution of the United States. Therefore if you have letter from an authorized authority within your command that will authorize you to purchase an off roster feel free. You can't carry it on your person unless you get a conceal carry permit for it.

An FFL willing to take such a letter and show it to the DOJ auditors?

      I suspect CA-DOJ will disagree.

I'm curious as to where the National Guard or Guardsman fall into this category. They are Military members who are also PC 832 certified and hold peace officer powers when activated by the Governor or when assisting local LEAs in operations.

Since the CA DOJ has said that the letter has to be the head of the organization, for the military that would be the President of the United States, so if you can get a signed letter, try it.

So every cop that buys an off roster has a letter from the sheriff or whatever stating which make/model they wish to buy and that they may use it in their official duties?

Does it prohibit them from using it off duty? That's how this reads.

I hate this commie state more and more every day.

Edit: at allpoint: maybe some civilians don't like that mil would have the privilege of buying whatever they like, but I'm sure they wouldn't be complaining when I found out I didn't like my gun after a few range trips or when I decide to upgrade... also in this hell hole, it seems best to get as many people buying as much as they can.

I just noticed this as well

It lists all of the agencies that CADOJ BOF is permitting to purchase non-roster handguns and says below the lists that sworn members (individual personnel) of the above agencies may buy or be sold to. Well they listed the military and naval forces of the state of California or the United States. Does that mean they are now allowing military personnel to buy off roster handguns?

Just waiting for them to release their revision...feels like a bunch of interns who just graduated college and have no real world experience are running the CADOJ...

Different relationship. For example, a Sheriff does not report to the AG.

Assault weapon law is in a different chapter of PC (Chapter 2), and has no relationship at all to purchasing off-Roster (Chapter 4). (Both are Part 6, Title 4, Division 10)

So, as a ffl, do you guys require, or are legally required to get (at least) eyes on an official document from the CLEO stating said officer may purchase? Does it specify make/model? Do they allow/prohibit off duty use in that letter?

I of course see nothing in the excerpt of the law posted saying written permission is required.

What I see, is that you just have to be part of an authorized agency, and promise to use it for duty...

CADOJ at one point briefly either did or considered requiring law enforcement to get a letter for purchasing off-roster, they received enough flak from law enforcement to nix that idea.

My local clientele is law enforcement only, when I was still located in California I don't think I ever heard a single good word from my California state, local and especially federal law enforcement customers with regards to CADOJ BOF. They routinely overstep their authority, I am waiting for the day the ATF puts them in their place.

So if there's no paperwork proving this, then what is stopping you (ffl) from selling a soldier/marine an off roster? Because you're technically within the letter of the law.

It seems like FUD was spread as fact, and it stuck throughout the ffl community. Maybe I'm wrong (most likely). Just not seeing it.

Wouldn't the doj see the dros and run the model number and say "that's off roster, who sold this?" And then look at it, and say "oh, ppt", or "he's a cop (when they search the purchaser's name)"?

Again, sorry that I just don't see the disconnect here. I appreciate all of your patience with my common sense logic in the bassackwards dystopia.
