    des authorized peace officer letter

    Has any ffl received the new (state exemptions for authorized officers) letter, im having a hard time trying to interpret this letter. Does this mean we canot sell peace officers non-roster firearms if its not for use while they're on duty

    if so will they have to provide a letter saying its for use while on duty?

    It says Agencies, not officers. Read the line after the bullet points.

        CA-DOJ interprets 'sworn' as PC 830 officer.

          only if you consider taking the enlistment oath to make that person a "sworn member of the military". CADOJ does not.

            The PC doesn't say anything about "for use in the discharge of their official
            duties".

            So, if an officer is willing to wait the 10 days we can no longer sell them an "unsafe" handgun if it's not for duty use?

              I have attached the letter for everyone to see.

              The people running the CADOJ BOF have lost their minds, these people are truly out of touch.

              The letter is listing which AGENCIES CADOJ BOF is permitting to purchase non-roster unsafe handguns which tells me they believe they can tell government agencies which firearms they can purchase and can not purchase.

              They also make an unsubstantiated claim that the models not on the roster are unsafe while the CADOJ BOF are not qualified to make a statement or determination based on a law they made that requires manufactures to pay a FEE and go through their internal tests, they are not experts by any stretch, to be sold in California, while other states allow sales of these firearms without issue.

                I was just about to ask about this here. I literally JUST let my LGS and he told me to wait before ordering any more off-roster guns until he gets an email back clarifying this email and if it restricts the individual officer from purchasing without a letter. I can only hope, cause I have 3 off rosters waiting on layaway that will finish my purchases for the next year or so...

                  It looks like they are saying the agencies themselves and any sworn members of the agencies listed can purchase off-roster but I find it peculiar that they make a determination in writing of what the AGENCY can or can not purchase when federal law puts not restriction on an official state/local government law enforcement entity.

                          I still don't understand why mil isn't actually exempt because cops can buy a weapon that ISN'T for use on duty or not allowed by their agency.

                          How do they prove that the weapon is for use in official capacity?

                          If they don't have to provide proof, then who is to say the off roster gun I want to purchase isn't for official military duties?

                          Edit: the same with big-boy magazines... some units do authorize pmags for use...

                            Simple reason, cop is special status citizen, they are exempt to laws that apply to regular citizen. Military is not considered special status citizen.

                              We were advised by the DOJ Auditor that Sworn MPs or Investigators with DOD may purchase off-roster pistols, however may not purchase hi-caps. They are treated like any other FLEO.

                              CA Peace Officers of agencies not specifically listed in PC 32000 are not able to purchase off-roster pistols e.g. County Probations Officers, Park Rangers, ABC Agents, Arson Investigators, etc. . ., however they may purchase hi-caps.
