A delay can only be 30 days, per CaDoJ. At the end of the 30 days they will have to determine if he is prohibited or not. If he is not, they could return an "Undetermined" to the FFL and then the FFL has to decide if they want to release the gun or not.The satisfaction of a job well done is to be the one who has done it

My guy knew he was prohibited and did not challenge the denial.
I sent him a USPS MO that he had to sign for.
Better than having him dog me in small claims court.
Dirtrider, if he's smart he won't bug you for $25.
Point out to him that you could call both local LE and the Feds about his attempt to purchase illegally.
What's easier, accept your offer or a possible LE headache?

I called the ffl today because the 30 days was up the 27th and they had forgotten about this situation. The did say the DOJ sent a decision of "undetermined" and they would not transfer the firearm to the other party. They did say they want to be the ones to tell the guy and the number they had for him was not working. I gave them another number I had from an email. So now what I am just standing by? for what? for how long?

Unless the other party is DENIED, it is not your problem. Once he is DENIED, the FFL must return the firearm to YOU. Sounds like they don't want to - but that, and the next steps, are on THEM, not you.
As far as you go, you have $$, and the buyer is waiting on a decision. Until he's DENIED, and they need to return the gun to you, you're out of the picture.NRA Life Member

Update: The ffl called me and told me to come pick up the rifle. I went there and they said I had to dros it back to myself, pay the fee and wait ten days to pick it up.
I contacted the seller and I told him our deal is still solid but I am waiting to get the rifle back before money changes hands. He is pissed and wants to sue me. This is fun. YAY California.
So lets review... I have the shotgun I received in the trade. The rifle I traded away is being dros'ed to me from myself. On wait day number 0/10.
I still want to pay the money for the shotgun IF I end up with both guns because I feel it is the right thing to do. Am I wrong to wait until I have BOTH firearms in my possession?Last edited by dirtrider04; 11-30-2014, 9:10 PM.Comment

Make sure you deduct the cost of the DROS and any taxes or fees that may be associated with the return if your rifle.
And yes, don't pay him dime one until you've got the other gun back into your clammy hands.
