This is exactly what i was looking for you need to get your gun back from the ffl because it's still your rifle unless it did transfer and they are doing some funny business.but on the other hand was the guy denied if not they may just not want to take responsibility for going through with the transfers if it's possible that he might be prohibited.
No, this is not correct. If the person receiving the firearm is DENIED, then the person giving the firearm gets the firearm back from the FFL immediately, no DROS, no 10 day wait. This is the law.
So, you don't need to do anything until the FFL returns the firearm to you. No DROS!!

(a) A person shall complete any sale, loan, or transfer of a firearm through a person licensed pursuant to Sections 26700 to 26915, inclusive, in accordance with this chapter in order to comply with Section 27545.
(b) The seller or transferor or the person loaning the firearm shall deliver the firearm to the dealer who shall retain possession of that firearm.
(c) The dealer shall then deliver the firearm to the purchaser or transferee or the person being loaned the firearm, if it is not prohibited, in accordance with Section 27540.
(d) If the dealer cannot legally deliver the firearm to the purchaser or transferee or the person being loaned the firearm, the dealer shall forthwith, without waiting for the conclusion of the waiting period described in Sections 26815 and 27540, return the firearm to the transferor or seller or the person loaning the firearm. The dealer shall not return the firearm to the seller or transferor or the person loaning the firearm when to do so would constitute a violation of Section 27500, 27505, 27515, 27520, 27525, 27530, or 27535. If the dealer cannot legally return the firearm to the transferor or seller or the person loaning the firearm, then the dealer shall forthwith deliver the firearm to the sheriff of the county or the chief of police or other head of a municipal police department of any city or city and county, who shall then dispose of the firearm in the manner provided by Sections 18000, 18005, and 34000.

The dealer could have lawfully transferred it, they just chose not to. In my opinion that makes it the dealer's problem, not the sellers. If I were the seller, I would have made it abundantly clear it is their problem and if they want to return the firearm to me, they would pay for all fees. Their choice, their money.

I hope this whole mess goes to court. NOT because i like that kind of thing but in the end the FFL will be drug into this mess and the courts will have to make a determination if this is really on the FFL.
In reality the firearm belongs to the buyer. The FFL must deliver what belongs to that buyer after the 10 day wait or the 30 day extended wait. Its a contract matter between the buyer and the FFL.Comment

That would be committing theft. The other guy owns the firearm that is in limbo. He cannot possess it, but he owns it.
If the OP gains possession of the firearm, he must make a fair settlement with the current owner.
I would not have done it this way, but at this point there is probably no going back.Comment

No I am not. However what the FFL did is against the law. They can only release it to you if the other party is denied as per the law. And in that case there is no second DROS fee. The fact remains that the rifle you traded is his legal property and you have no legal claim to it.
