    I'd sell you my used Mossberg 500 for $200. There, now you can tell him you're actually being a nice guy and giving him $50 over the going rate! You certainly have the leverage in this situation, and if he really is a prohibited person he should have known better than to even attempt this. He's lucky to be getting anything out of the deal, as his gun could just as easily be sitting in an evidence locker.

      Clarification on my original post. After months of delay DOJ finally declared him as denied due to a felony. This despite the fact he has never been arrested. Currently he is several thousand dollars into lawyer fees trying to unscrew DOJ on it.

          If he is not willing to take your more than fair offer, let him know that you will return his gun to the FFL, and he can determine how he wants the FFL to handle the disposition of the property that he cannot take possession of.

            Just spitballing here as I have never sold one on consignment, but why not offer to keep the Mossberg and have the FFL sell the one that the buyer was supposed to receive from you, proceeds to go to the buyer?

              The other party's problems are not yours.

              Personally, if the deal was done, the deal was done. Unless the other party is a friend of mine, I'd want to be compensated for any additional time/effort that I would have to expend.

              If $320 is a fair price for the shotgun, fine, but now you want to be compensated for the extra hassle that he's put you through. $75 sounds alright? 320-75 = 245. Though personally, I'd charge $100 because my time on the weekend is very valuable.

                    I agree with this, perfectly fair and it gets him out of a situation he may/should not want to get in to any deeper.

                      I was trading a shotgun for a handgun, we did the PPT / DROS / 10-day at Turner's Pasadena.
                      I was approved, the other guy wasn't (BTW he said he was a LEO so the DOJ approval would be automatic for him).
                      When I went in to pick up the handgun, Turner's advised me that the other guy was denied.
                      Turner's was very helpful, they contacted DOJ while I was there and they got the shotgun released to me without further wait or cost.
                      So I walked out of Turner's with both guns, and with both now in my name.
                      (Despite being a long gun, the DOJ did say that they recorded me as the shotgun owner due to the denied sale and immediate release situation).
                      I called the guy and told him what was going on.
                      He asked me to meet him locally and just give him the shotgun!
                      I said "no way" was he getting a gun from me....especially if he is prohibited and the gun is most definitely in my name.
                      But, trying to be fair, I checked GB and mailed him a check for the average price of the handgun (both guns were cheap so fortunately it wasn't much money).
                      No I did not let him whine about the price I determined.
                      I could have left him high and dry, he really didn't deserve anything as he lied to me about being OK to buy and a LEO, but at least I am done with him.

                        You have all the power.

                        If he decides not to take your offer, and must sell it through the FFL, its gonna be way less than your offer.

                        If he were to sell it on consignment and he got $250 for it (no way he's gonna get more than that), then factor in the FFL consignment fee, frequently 20%, he's now down to $200. If it turns out he has to sell it to the FFL, now were down to $150-160.

                          You were lucky your situation was basically drama free because....

                          Brief update: After he agreed to accept my generous offer, he came back with "I thought about it and I will only accept $275" he went on to rant about having the right to take me to small claims court and blah blah. These convos are all done via facebook so I have all the admissible evidence I need. So I guess the $25 difference is worth court costs and time to this guy.

                          I have not responded to him at all since that convo. I am going to follow your example and mail my preferred amount to him. I don't need anything stupid happening in a face to face meeting with this nutjob. Thanks to all that have contributed.
