I traded firearms with a fellow a few weeks back.. I don't believe he is a member here...I picked up my "new" firearm on Nov. 7. The FFL told me they were not able to release the firearm I traded to the other party. I contacted him and he said he was delayed but no big deal. Today he contacts me and wants me to pick up the gun and go with him to a different FFL to transfer it into his wife's name. Now at first I was like ok no big deal... then I remembered this is CA and I don't want anything fishy to come back on me. WWCD?? (what would calguns do?) Thanks.

Part in bold, makes me think he got denied due to being a prohibited person and now wants you to transfer it to his wife (straw purchase).

OP can't really 'walk away' from this situation, as others have stated. He's already in possession of the other party's gun and would have to PPT it back to him to reverse the trade, but it doesn't look like that's an option or this thread never would have been created in the first place.
There's really no easy way to fix this, other than negotiate a fair price for the gun OP received, pay it in cash, and recover his other gun for sale at a later date. Absolutely do not sell the gun to his wife, or anyone else related to him.Comment

I don't think he *can* "walk away", he has his compensation already.
You'll need to do one of two things:
1) Pay him an appropriate $$ amount for the gun you have (since we don't know if he's prohibited yet, you can't trade back), or
2) Nothing - have him wait for his "delay" to clear.
If you choose option 2, and he comes back prohibited, you're left with option 1.

I'm glad you are all saying what I was thinking, I just feel bad because I don't want to leave the guy with nothing. But I will not risk my freedom for someone that already compromised theirs. If he ends up being totally denied do I...
......just go pick up the gun like it is mine?
...does it get transferred back to my name?
I don't mind getting the gun back and paying him fair price for his original gun that is now in my possession.

if the other party is denied, the FFL should be directed by CADOJ to return the firearm that the OP had sold back to the OP. at that point, it just a civil issue between the OP and the other party.

Don't do it. Circumventing/ignoring California's illegal gun laws are all and good when you're not dealing with obviously shady people on an official basis, but this sounds like one of those times you're going to serve yourself best by just walking away considering you've already got a licensed FFL involved.Comment

If he is denied the FFL can immediately return the firearm to the seller. As no transfer has taken place there us no need to re register it back to you.
A possible solution to your other problem if you don't have the cash to just pay him off is to sell the firearm to another person.
