CA DROS Delay

    If I remember correctly my first fast track to delayed went, pending /delayed /undetermined. I know there was a pending in there . My second trip down delayed Blvd. Went straight to delayed on like day 4. Crazy to see the massive uptick in such a short time . I would not be surprised if all the dross'go delayed in the future . And I still think that the numbers they give for undetermined are being kept separate in order to confiscate them later under the guise of some up and coming reason to prohibit .I do not put anything past those who could care less about anyone's personal liberty by means of individual responsibility.

      Right after the DROS is submitted it starts as pending, what you described is a normal flow to undetermined: Pending>>Delayed>>Undetermined -- this is what we see for all undetermined. Undertaker is getting hosed.

          This isn't a standard "undetermined" though. This case as Undertake has explained is CA DOJ not changing the status to undetermined and allowing the FFL to release after 31 days (regardless of the reason for it being undetermined). There's specific PC that CA DOJ is violating.

          Further the definitions provided by CA DOJ say "Pending" is only valid during the initial 10 day waiting period.. the fact his DROS is in Pending state after that further conflicts with the law.

            I know - that's what makes it even more confounding, infuriating! It also serves as supportive evidence this is likely intentional obstruction by an illegal DOJ agenda, with no just cause.

            It's beyond coincidence or strange; it's just another development in the evolution of the DOJ's hostility, because this continues to go ignored by the 2nd Amendment rights organizations.

            The delay to respond to this is allowing the DOJ to further develop their use of this tool for authoritarian control and reduction of guns sales (especially when combined with 1-per-30 day purchase restrictions) as they proliferate these civil rights violations with smug impunity.

            Who knows, maybe that's CRPA's strategy; to intentionally allow the DOJ to carry on like this, get arrogant and bold, and let these violations become a tidal-wave that can't be ignored by the courts, versus a ripple that can be dismissed as a simple "oops, didn't mean that" - I can only hope so.

              Confirmation citation as to the bolded. Is Ca pc-28220 [4]

              (4) If the department is unable to ascertain the final disposition of the arrest or criminal charge, or the outcome of the mental health treatment or evaluation, or the purchaser's eligibility to purchase a firearm, as described in paragraph (1), within 30 days of the dealer's original submission of purchaser information to the department pursuant to this section, the department shall immediately notify the dealer and the dealer may then immediately transfer the firearm to the purchaser, upon the dealer's recording on the register or record of electronic transfer the date that the firearm is transferred, the dealer signing the register or record of electronic transfer indicating delivery of the firearm to that purchaser, and the purchaser signing the register or record of electronic transfer acknowledging the receipt of the firearm on the date that the firearm is delivered to him or her.

                False impression? Or not willing to broadcast strategy on the interwebs before they are ready to KICK some LEFTIST BOOTY at DOJ? Considering the Bruen BIG WIN decision. I can only imagine how busy ALL the CRPA attorneys are.

                  My FFL contacted the CADOJ this morning. Supposedly the misspelling of my first name isn't the problem. DOJ said they should have it corrected by tomorrow. Told me to check back tomorrow afternoon.

                      So I just got a phone call, I approved to pick up my pistol now.
                      I would hope someone actually read my nasty gram I sent the DOJ. But you never know.
                      29 days in on the third delay and they release it. WTF??

                        I'm happy you got approved and got to pick it up was this from the same original DROS or did you have to re-DROS and pay again?

                          I have heard that it typically takes around 3-4 months to clear the problem that caused the initial delay.
                          Until it's cleared, you will continue to get delays on every DROS as one delayed DROS is cause to delay future DROS so you are stuck until the problem is cleared.
