CA DROS Delay

    Purchased on June 18, 2022. Pick up date should have been the 28th. 26th, DOJ delayed. July 26th they extended the delay. Still waiting!

        What do you mean the extended the delay? By law they have between June 18 and July 18 to figure it out or it goes undetermined. They can't extend the delay to July 26th...

        Unless your post was wrong and you're saying you purchased on July 18 and pickup was supposed to be July 28th with the delay happening on July 26 (and no "extension") of a delay.

          Supposedly there is a button from DOJ on the form to allow the FFL to release the weapon but the DOJ hasn't, won't make the button active and I'm told that on the 28th day they extended the hold. I have emailed the DOJ twice. First one they sent a cookie cutter response. No response from the 2nd email. And yes, June 18th was the purchase date. Still waiting, I checked this morning.

            The button appears on day 31 or 32 at the latest. You have a right to sue as they are breaking the law. Your dealer can release if he calls in to get the new NTN number. He can also call the Dealer DOJ hotline to have them mark the actual release date.

            Your dealer can do something about this (assuming they release on undetermined).

            I have not seen a single Delay ever get extended and have heard that happening until your case.

            If it's a matter of that button appearing your FFL should be able to contact CA DOJ to get that corrected.

            If this is truly an "extended" delay then you should get another letter which I would encourage you to retain counsel (perhaps someone willing to do pro-bono) to sue. Confirm with your FFL that they received another bulletin as well. If they have not then something smells funny.

            If they have, ask them to at least send you a screenshot with the verbiage stating this is an "extended" delay and post it here (obviously redacting any personal info). I'd really like to se what this looks like.

              I have never heard of an extension I thought after 30 days the DOJ washes their hand of it and that you would have to pay up and start the process again.

                This is how an undetermined works (in all cases except the poster above):
                Day 1 - DROS Starts
                Day X - Delay from DOJ preventing pickup after 240 hours / 10 days.
                Day 31 - DROS changes to undetermined and then you have 30 days from this date to pick up assuming FFL release on undetermined
                Day 61 - DROS is expired and you would have to ReDROS

                DOJ essentially "washes their hand[s]" on Day 31.. With the exception of giving the FFL the federal NICS NTN number to release the firearm if the FFL chooses.

                    Ok, I think I figured it out. Yes, my FFL would release to me after the 30 days "If" it said Undetermined. They had told me it said extended. I asked them to print out what the DOJ told them and it said Pending. I started reading the form and first thing I noticed was that they misspelled my name. Ken instead of Kent. I'm guessing that may be the hold up, which I except responsibility for not catching that in first place. Had DOJ explained their problem, we could have corrected it a long time ago.

                      Did you get pictures of anything? Here's what a delay normally looks like (this is a current delay):
                      On Upper Left Header:

                      EARLIEST DELIVERY DATE/TIME: 07/18/2022 04 : 29 : 07 PM
                      LATEST DELIVERY DATE/TIME: 08/07/2022 04 : 29 : 07 PM

                      On upper right of header:
                      STATUS: DELAYED

                      Are you saying STATUS: PENDING?

                      I've never seen that on a delay.

                      For this customer on 8/8 or late on 8/7 the STATUS will change to UNDETERMINED and then the latest delivery date will change to 30 days from 8/7.

                      I'm not sure if you're referring to a different bulletin. Sorry can't be of more help.

                          That's not how it works though..

                          Can you post the dates in the upper left?

                          I've never seen a Delay turn into Pending.. DELAY means they are still working on it (regardless of reason).

                          Technically you can't be pending on day 11, you are either Delayed or Approved.

                          After day 30 you should be Denied, Approved, or Undetermined according to the penal code.

                          Whether or not you decide to sue you may want to contact CRPA as this is most definitely violating your civil rights and CA DOJ may very well be breaking the law. (IANAL)

                              I think you have lawsuit material or at a very minimum providing the evidence to CRPA or other similar organization that needs plaintiffs against CA DOJ for one of their lawsuits.
