There'll be a law suit on that. The DOJ may deem it's not worth another law suit.Comment

Thank your neighbor and fellow gun owners for passing Prop 63. For that gun control is a winning legislative agenda.

OK, so, what does this do for firearms like the SKS D and the SKS M? Being as they are 'banned' due to detachable 'large cap' mags? The thing with firearms is that they are not like any other consumer product, simple ownership of one carries a lot of responsibility.
Some idiots are too busy knowing it all to ever learn anything

No, and they never have been.Sean,
Congratulations. It looks like your firm did an outstanding job here. I know that there are going to be a lot of questions flowing from the decision.
But one question that really troubles me is that your firm focused exclusively on Penal Code section 32310 which provided criminal penalties for acts relating to large capacity magazines.
Judge Benitez wrote very specifically to the constitutional rights of those possessing such magazines, and to the level of scrutiny the courts must apply in considering constitutional claims.
I didn't see your firm make any issue with Penal Code section 32390 permitting the non-criminal seizure of such magazines, nor did I see PC 32390 addressed by Judge Benitez.
Are Californian's still at risk of having their lawfully possessed large capacity magazines subject to civil seizure?
This law never went in to affect thanks to the preliminary injunction obtained by the CRPA and NRA.
And for the record I've never stopped using my standard capacity mags at the range.sigpic NRA Benefactor Life Member / CRPA Life Member / SAF Life Member

Does this decision affect the entire state, or only the district wherein this judge is seated?"If a person who indulges in gluttony is a glutton, and a person who commits a felony is a felon, then God is an iron."--Spider Robinson.

He's still a Federal judge, no? There are lots of openings on the 9th Circuit bench.Judge Benitez did a very good job on this decision, but he's probably not a viable candidate for the Supreme Court.
He's currently on "Senior" status. The President seems to be looking for Supreme Court candidates that are very young and very healthy.
Someone would inevitably question his legal education. He graduated from Western State College of Law before it became a legit (ABA Approved) law school in 2005.Comment

I would guess zero chance. But at least you wouldn't get prosecuted for buying, just possessing, assuming you're dumb enough to keep them after the decision is appealed and final.Comment
