I agree with you. I posted a few pages back that the OP had an "idea" that something was not right about the LOW price by asking multiple times about the price. I think the OP should not get the free gun but get a full refund. I was BASHED by everyone saying "contract,contract,contract,contract!!!"

i'm glad this worked out.
to address who would have won "in court" my guess would be the OP. this is not a case of accidentally selling a $1 million car for one penny. it isn't a deal that is so obviously wrong that no reasonable person would think it is legit. it is a case of taking a deal (buy one get one free) and then applying another discount that was available at the time. if turner's rules were that the discount shouldn't apply to the buy one get one free deal, then the burden is on them to make sure their employees don't apply the discount, either through training or programming their cash registers to not allow it. but the employee did the deal, the customer paid the full price, came back 10 days later to pick up his guns and was denied. if i was a small claims judge, i'd not only award him the two guns, but mileage, court costs and time as well.my Benitez goes to 11Comment

I've got 10 years on you for that - I've been BUYING (not just shopping) at TURNERS for 25 years, having a regular track record with Turners - and no problems either.
I've stated this many times before in other posts, that I've never had trouble but have watched repeatedly the screw job dealt to others. I've often circumvented trouble that could have been given me by being knowledgeable enough on the proper laws and protocol for paperwork and processing to correct a situation propagated by a Turner's employee's arrogance in ignorance, before it got bad.
It's only in the last couple of years I've sought buying elsewhere, primarily because with lucrative success matched by a correlating income, "saving" a few dollars is not as paramount anymore as had been a quarter century ago, where I had to put up with incompetence to save a buck, where now the reliability of service and surety of doing things right is worth a few dollars extra to avoid so many of the repeated issues posted by others about Turners on a near weekly basis.

.I Received a call from Turners this morning informing me of my options. I can return the Bushmaster for a full refund
A judge would say the store offered your money back . How can you have a case if there are no damages ? The store is not obligated complete the transaction . They can say , sorry we made a mistake , here is your money back . That is reasonable outcome and I believe the courts would have seen it the same way .
I'm not saying the OP was not screwed over or that Turners was not wrong . Only that Turners had another reasonable option to give the customer .
I had something like this happen at Turners as well but not really . I bought a Savage XP model but was charged the sale price for the same rifle with out the scope . The manager noticed the mistake during my pick up but let it go . I think it would have been a $70 difference to me and likely only a $30 loss for them so not quite the same as the OP .

i think they should have caught the mistake BEFORE or during the DROS. i would have no problem if they refunded his money the first time he was at the store.
but once they did the DROS, and especially 10 days later when he had to drive back to the store to pick up the guns but was denied, it is too late in my opinion. the guns are legally his and he spent considerable time and money making multiple trips to the store.
and we're only talking about $300 - not much money for a large retailer. take your lumps, learn from your mistakes, and use it as an opportunity to train your employees better. or use it as an opportunity to create a PR nightmare.my Benitez goes to 11Comment

Getting screwed by Turner's and then making it right by them means nothing since they had to screw you first before they turn out to be good guys.
They should have been the good guys from the very beginning. Making it right means you did something wrong in the beginning and to take that long of a time to fix it still makes it wrong. How many meetings did it take them to come to the right decision?

Not without the buyer's consent. Just because they performed the DROS does not give them the right to alter the transaction. They were holding the OP's property against his will. Turners acknowledged their mistake and released his property.
Was the scope on your receipt???? I agree that they did not have to give you the scope if you were not under the impression they owed it, and you did not have documentation it was yours. A salesman simply offering to sell the customer the car for $.01 is not the same thing as actually selling the car for that amount, which would include the Sales Manager approving the transaction through the point of completing a sales contract. At which point it would indeed be binding on the dealership, unless they could prove collusion between buyer and their employees.I know this is over but I disagree a bit with most that have posted . Yes the receipt is binding but at the same time . If an employee makes a mistake like that the store does not have to comply . Lets say a car salesman sells a 1 million dollar car for one penny . The dealership does not have to give up that car $.01 and will win in court . Why ?? Because that employee does not have the authority to change prices , period .
If this went to court Turners would have won IMHO . They had fliers all over the place stating the cost . I remember the email I got stating that very deal . The employee just rang it up wrong that's all , there was no attempt to deceive . All they were legally obligated to do was return all his money because of the mistake . They did not have to honor the sale . They made a smart business decision here . Why spend a few thousand dollars on court cost to save the $200 they are likely loosing on the sale . This was just easy math for them and maybe they look honorable at the same time .
Just as happened with the OP, the cashier DIDN'T simply ring it up wrong (you CAN'T do it that way in CA for a gun). The sales person repeatedly told the OP the lower price was correct AND the Store Manager approved the completed paperwork package for the DROS (which includes the prices and what weapons are involved) prior to the OP paying the cashier and leaving the store. Thus completing a legally binding transaction.

Well that applies to the car dealership too. They can't change their mind after the fact either because they realized they made a mistake.
