Pretty much all the Turners in California have been taking money for pre-orders.
Plus a lot of other gun stores.
I doubt all these stores would be taking peoples money only to have to refund everyone because the gun ended up no being available.
I am sure all these stores verified it was legal and would be shipping to California before they started taking deposits.1 Peter 3:15

How about a temporary moratorium on KSG pimping until such time as Kel-Tec actually delivers in the distribution channel on at least some of the pre-orders out there?
I'm waiting patiently for them to take some flack at the next SHOT show for their (so far) apparently vaporware.

The DOJ is not in the business of "approving" anything other than handguns.
They have had plenty of notice that the KSG is coming and what it's magazine configuration would be.
Turner's is one of the more careful dealers, and they have had no indication from the DOJ that it's a problem.- Rich

Sorry to cut hairs, but this is not vaporware. The web is FULL of movies and reviews by dozens and dozens of weapons stores and online blogs and such - some very well known like NTF. This means dozens and dozens of existing test models really being used. As well hundreds and hundreds of photos in various locations and state of undress. Plus, Kel-Tec's very own 8 minute video on YT showing the gun & it's functions and it's claims of the fact it's coming - on video and their very blog where they clearly address if it is coming or not.How about a temporary moratorium on KSG pimping until such time as Kel-Tec actually delivers in the distribution channel on at least some of the pre-orders out there?

Generally speaking, vaporware is more about rumors of a product with no actually working product (or maybe stock pictures of 1 product used by every online media over and over).
This gun clearly exists, clearly is coming, it is - like the Galaxy Nexus phone or Asus Prime tablet - delayed or slow to come to market for 1 reason or another - in this case most likely due to those specific like 4-5 changes they made from the first version. Pre-production and evaluation pieces do not equal production. Until actual production takes place and units are in the channel to be sold, it's at best a beta... hence still vaporware in my opinion and from working in the software industry for a while and being involved in such shenanigans. All the various videos and tests out there are the same as a CEO trotting out some cool new app or gizmo at the company meeting. Over promising and under delivering... Kel-Tec has something of a reputation for that. This is why some observers are not surprised there are pre-orders languishing for months and months, and that FCS dates have slipped. Last one I saw was October... what is it now?
Good rule of thumb.... if the item still has at least a year left in the development pipeline it's not a good idea to start pre-selling it with "coming soon". Every time you push the date out, for perfectly legitimate reasons, you will alienate more of your potential customers.
That's what they are doing. It's disingenuous at best, and downright disrespectful of their (potential) customers at worst.
