      Likely Glockworld.

      The call apparently came today. CaDOJ has been out for the holiday weekend since Friday. If they had issued a ruling on Friday, we would have heard something of it other than two different people referencing Glockworld calls and emails... especially since Glockworld is not the only place that's been taking pre-orders, and nobody has reported that Turner's has canceled any pre-orders.

      Glockworld probably got a phone call from a DOJ staffer who doesn't understand the law... or more likely, from someone in the Brady/LCAV camp who doesn't care what the law says.

          Even if the DOJ rules the KSG to be illegal, it would not be illegal to receive one from Turner's.

          Thanks for explaining that. I agree i don't know why or if they need to take any position. As for the legal liability of a purchaser, I indidated why I thought there should be none since the legilature's could of but did not list the purchasing of a large capacity magazine in Penal Code section.

            I think they intended to, because the exemptions are full of "Buy from/Sell to" language, as well as "legally possessed" even thought possession is not a crime.

            I'm thinking that perhaps possession and acquisition was removed through the amendment process prior to it being sent to Davis for his signature.

              From Bill. Not stated as an official statement from the CGF, but keep in mind that even Bill was skeptical about OLLs in late 2005.
              If there were any question as to the legality, I doubt Bill would have made that statement.

                Almost everyone is acting like a few protoypes on a gunshow table means it's ready and available.                 Shotgun tubes hold 6 and 7 and I think one holds 8, not counting the chamber. Are you saying a 7 shot 870 or 8 shot Mossberg for instance is illegal or are you speaking of magazines and not tube fed firearms? I don't know much about shotgun laws. I always thought tube fed like .22 caliber rifles were exempt. Thanks in advance.

                  Tube fed are ONLY exempt if they are on a lever action rifle, or .22lr.
                  Interestingly enough, a .17mag or other rimfire is not exempt.

                  But as Bill commented, there was a case brought that claimed that the 870 7rd mag could contain more than 10rds using a custom cartridge under the normal 2.75" length, and it was rejected.

                  Tonelar is referring to the total capacity of the feeding mechanism. If the DOJ rules that two 7rd tube mags = one 14rd mag, then all we need to do is have the tubes blocked to hold only 5rds in each one and we're golden.

                      Gene has found a legal pathway for any California resident to purchase high caps, and it does not involve an armored car company.

                      After a few initial key transactions, a lawsuit will be filed to toss the whole freaking thing. This lawsuit will not be a 2A-based case.

                        Interesting. I like the point he makes about the ambiguity of magazine capacity. For example a Mossberg marketed as holding 7 in the tube may take in excess of 10 specialty rounds.

                        As for the rest of his analysis, it seems to be based on an assumption, that he was told, that the magazines are separate. I approach the issue without any assumption.

                          my bad... I am aware of the workaround etc. However I didn't think it'd have an effect on the magazine cap law (other than rendering it irrelevant).

                              It's virtually unenforceable now.
                              Use the workaround to make it completely irrelevant and unenforceable, then use the courts to establish case law that it is irrelevant and unenforceable and it is removed from the books.
