Just ask them nicely to ship it to another FFL in your area what will take it and install the BB. You will pay the shipping. Find another FFL who knows the real deal.

Don't waste your breath on a person who has heard it 1.5 billion times and refuses to listen.

If the lower was shipped with a standard mag release button installed, how is that not an assault weapon?

If it has a caliber indicated on it, ie: 5.56 - that's not rimfire.

If it is stamped MULTI - it can accept a centerfire upper.

Does this not become a "constructive" issue?

The stamp on the lower does not mean the lower can't be user with a .22lr upper.

If he threw on a .22 upper he would not need a bullet button. A lower without an upper is NOT a centerfire rifle.

IIRC, constructive possession does not apply to ca AW laws.

J&R is the ffl? I'm surprised. They are incorrect. As others have said, without a centerfire upper attached, it is not an AW.

Call them and ask them why they believe its an AW. Also tell them that the lower is not a centerfire rifle because it has no upper attached.

Yeah... that could be the reason he won't do it for you. I just happened to be at one of the local shops here one day when the guy was on the phone with someone who had a firearm shipped to him without asking first. Ater hearing what he had to say about it, I can totally understand why that bothers them.

Wow... Just Wow. I don't even know what to say to that. Maybe they need Livermore PD to laugh at him and tell him he is a jackass. It's just sad that there are still so many who don't know how to do their job, and its not like the law is that unclear, its pretty straight forward and gives a pretty definitive description on AW, granted there is a bit of room for interpretation, but hell, its not like its the Tax code or something.

Pay for shipping back to RifleGear, and steer clear from these people, warn everyone you know or meet of their complete ineptness in their field. Sooner or later they will learn, or go out of business for refusing to see or learn the truth. I bet he tried selling you a musket when he declined your lower

Tell me about it. I just spoke to rifle gear and they were pretty shocked they would go through those lengths to get people in trouble. What a bunch of douche bags. Well, rifle gear will send a return label to them and have my items shipped back.

Rifle Gear are good people, just sucks that you need to go through all this BS. but at least you learned a valuable lesson, even though this BB/OLL thing has been around for a pretty long time, not everyone is on the up and up. Learn your BlackRifle friendly shops in your area and you won't have to go through this nonsense again. Most have been in your similar position, maybe not as severe, but most have been caught off guard by the shear ignorance of the "professionals" we encounter.

Consider this one minor speed bump in an otherwise wonderfully bankrupting addiction that is black rifle fever

Does J&R sell complete ARs or stripped lowers?

Repeat after me, a complete AR lower is NOT a semiautomatic, centerfire rifle. It is no different that a stripped lower in that regard. It must be recorded as a receiver on the 4473, NOT as a rifle. A bullet button is only needed on a semiautomatic, centerfire rifle that contains a banned feature such as pistol grip or collapsible stock, etc... The customer even ordered a Bullet Button and we shipped it along with the receiver. I cannot believe they are threatening to turn it into the police. Wow. We will take care of you with a return label and we will even ship another receiver to a different dealer as soon as you get back to us on who to use. Try Bullseye or Irvington Arms.
