i wanted to buy a simi-auto centerfire rifle that eats and spit cheap russian ammo just for plinking can on the range, is it legal to posses a SAIGA 7.62x39 rifle in California?

Um first off 1mean76 I suggest you look around here a little bit on Calguns and actually learn something before its time for you to give someone "Duh!" advice. I say this because you are dead *** wrong. To the Mossberg 500, Hello and welcome to Calguns!You may definitely get a Saiga here in CA and as long as you keep it in its original configuration you may have it as a readily-detachable mag setup without a mag lock or anything "gay" like that. However, if you want it to look more like an AK then you can get it converted so that it has a pistol grip. You will have to use a bullet button or other mag lock if you do go that route tho.

So if it is a Kalashnikov USA Saiga, then the answer is no, it is an illegal assault weapon.
However, in all likelihood it is a Russian American Armory Saiga, in which case it can be legal. However, you would then need to make sure the rifle complies with PC 12276.1 http://ag.ca.gov/firearms/dwcl/12275.php
12276.1. (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
(1) A semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and any one of the following:
(A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
(B) A thumbhole stock.
(C) A folding or telescoping stock.
(D) A grenade launcher or flare launcher.
(E) A flash suppressor.
(F) A forward pistol grip.
(2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
(3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.
