He wasn't denied for for the offense, he was denied for not disclosing it.

We have said it here many times but just in case someone missed the memo:

NOTHING IN YOUR BACKGROUND IS IRRELEVANT WHEN APPLYING FOR A CCW

I am sorry this happened to you OP and I hope you are able to get it cleared up, but if nothing else, this needs to be a lesson for anyone who will be applying for a CCW. DISCLOSE EVERYTHING YOU CAN REMEMBER, EVERY FART IN CHURCH ETC

You can have a "felonius" record without having a felony currently on your record. Plenty of people have been convicted of felonies then later had them reduced to misdemeanors. Describing those people as having a "felonius record" would be accurate for many purposes. In fact such people are required to disclose it when applying for certain professional licenses.

Also in the eyes of LEO, having ever been arrested for anything that could be charged as a felony might constitute a "felonius record". LE does not just consider convictions when reviewing records especially if it is for people applying to be a LEO or in this case a CCW

All how they are looking at it. Yes they can say it's a felony under federal standards using identity theft laws. Some countries are not looking to do you any favors. Look up 18 U.S.C / 1028 .

UPDATE: Got in touch with the ALCO records division today. They informed me to reach out to ALCO IA as they were the ones who sent the letter of dis-qualification. Got in touch with ALCO IA and was told that I had a felony conviction in Aug of 92 in Chicago, IL. I explained to them that I have NEVER been to Chi so this is a mistake. They then explained to me that the burden of proof to clear my name is solely upon me. WTF ! I was given the date of arrest or conviction, (NOT SURE) and contacted the superior court in Cook Co, IL. After speaking with several departments I was told that they do not even show an arrest with the name, DOB and dates I provided in their system. I then called IA back and explained what I was told. They informed me to get that in writing from the records dept. Once I provide that written statement to ALCO IA, they can investigate further. By the time I called Chicago PD back that department was closed so I need to call back in the morning. Wanna hear the kicker ? When I asked ALCO IA why this felony NEVER came up during ANY firearms purchases they said, (SOMETIMES AGENCIES MAKE MISTAKES) ! I cordially replied with, (LIKE THE ONE YOUR AGENCY IS MAKING NOW). Silence ! I will update further when I have more, (Hopefully positive info) tomorrow. ✌

UPDATE: Received official FBI background report from the link that SkyHawk provided, Thank's again SkyHawk ! DRUM ROLL.............. The only record of an arrest was the arrest from 1987. Nothing from Chicago. I forwarded the information to the ALCO IA and they STILL want the letter from Cook Co. reading that I have no felony records in that county. SMH ! Cook Co is mailing the document to me today. I will update this post when any new info is received. ✌

They are asking you to prove a negative

What is Cook County sending you exactly?

They are sending a letter from the clerks office of the Superior court of Cook county stating that "I" do not have a felony conviction in Cook Co. or Illinois based on my name, DOB, DL and SS#. The supervisor was surprised that any agency would start a CCW background check without fingerprints. As am I ! The Live Scan portion should be first in the app process.

I am in a very similar situation with not disclosing my sealed and expunged juvenile record. Is there any lawyer that can help me or someone lead me in the right direction. I had one for 2 years, this was a renewal denial.

Man, they really got you working for it…

Only advise I can offer, is that you redact some of the personal info posted here when your thread concludes

Clearing up the mistaken identity issue isn't going to address the other issue in the denial. I don't think there is much you can do to fix that one, other than try again in a couple years and disclose everything.

You mean you have not even done a livescan??

Imagine if your name is Paul Jones or Tim Smith...

While it comes as no surprise being this is Alameda we are talking about, it seems like this IA will do anything to avoid issuing a CCW including inventing crimes.
