    Pulled over while carrying

    Got pulled over this morning on the way to work. Got caught holding my cell phone by a motorcycle cop.

    Gave him my DL and CCW license together and reached over to my glove compartment to get my reg and ins. I did not verbally tell him that I was carrying. He asks me where the firearm was and I told him at appendix. He says ok, gives back the CCW license then goes back to his bike to print out my ticket.

    This is my second time getting pulled over while carrying. This is all you need to do. Also, don't be putting your hands near the firearm. Don't worry and don't stress. You'll be good and you might even be let off with just a warning which happened to me on my first encounter.

      Your profile doesn't indicate where you live, but some IAs might consider this sort of thing as evidence of poor judgement under the good morals clause and use it against you.

        Maybe you just left it out of the story, but I wouldn't be reaching for a damn thing until told to do so once I had handed over my CCW or told the officer I was carrying.

          I can't imagine any IA holding a cell phone ticket against you. I really don't think society would go downhill if we all held are cellphone to our head while driving. You know, like it used to be legal just a few years ago.

              You are correct. To play it safe, one probably shouldn't reach for anything. I felt comfortable with the situation and he did ask for reg/ins right before getting I went into my glove.

                A small input. I dont reach ANYWHERE unless the officer verbally tells me to. I get confirmation that its ok to open the glove box.

                You just told him you are armed from the permit, he doesnt know where the firearm is. The order you told it, you reached somewhere before he know where the gun was.

                  My ONLY tickets for the ten years prior to my first ccw were cell phone tickets.

                    Perhaps. If this is your only ticket it probably wouldn't be a big deal. Each IA makes their own policy though. OC seems pretty fair.

                          I agree. I cannot imagine an IA using a cell phone ticket against you. As a former police officer, I would not reach for anything else unless instructed to do so.

                          You have no idea if there were any other undertones in the reason he/she stopped you. I cannot tell you how many times I stopped someone who loosely matched the description of a shooting suspect from 3 weeks prior for their license plate light being out.

                          Usually, when I stopped someone with a CCW, I knew they weren't wanted or on probation/parole so the stop usually ended with me handing it back and saying slow down or get the light fixed, etc.

                          The only exceptions to that were when I was working a traffic grant. Then they would get the ticket. And of course the one idiot who was drunk while driving and carrying...
