    I fixed the typo.

    You are focused on how long a single sale lasts, or in other words takes to complete, but that is a different issue than trying to add an additional sale, to the previous sale, and claiming it is part of the original single sale, rather than being a multiple sale.

    It is an informal poll :-). You claimed that you were winning 2 to 1, which is not correct, except in your own mind.

    I have heard that you, Wes, are a school teacher. If you don't understand the word "single" and instead demand to have it defined in the PC, perhaps that explains issues with schools.

        No, it is not a "pissing match".

        The fact is that the CA DOJ says that you can't add firearms later, especially not after the day that the DROS was submitted. It is a simple concept as to what a single sale is. It does not matter how long it lasts since if you add something, it is not part of that single sale. Due to the view of the DOJ, it is risky and foolish to add firearms later. I don't consider it acceptable to promote an action which at best is questionable and which a reasonable person would say is illegal.

        If you don't like, get the lawyers to get it changed. It should be legal to add firearms. It should be legal to include long guns with a handgun DROS. But the law is not what it should be.

        It is not responsible to promote such activities, especially on CalGuns, especially for a member of the CalGuns Board.

          My mind started to go numb reading this exchange.... :-p

          I worked recently for an FFL that would promote add on sales by selling the customers on another long gun by adding it to their 4473/DROS on delivery day, regardless if it was a handgun or long gun DROS. Somewhat recently he was "informed" by DOJ that this was a no go situation, even on long gun DROS's.

          Where do we stand? Is there a definative answer to this question?

          As a new FFL myself I don't want to make any mis-steps that might lead to my early demise as a dealer......

            Unfortunately, the background check is no longer just a background check. It has devolved into the state wanting to keep track of the number of firearms being purchased (and more fees, perhaps). I don't think there is a legislative mandate for tracking to support this but that is what has happened apparently.

            A long time FFL once posted that when the DROS software first came out and the state had training classes that adding long guns was not an issue.

            Was your former employer actually written-up or just warned verbally?

                If you look at the CA PC, I think that you will find that it is not legal. The first issue is that it has to be part of a single sale, which selling a second firearm at a later time really is not part of a single sale. There is also the requirement of a waiting period after the sale of a firearm, which handing over the additional firearm without the waiting period would be a problem.

                The bottom line is it really worth the risk to add a long gun like that?

                  Well with the passage of AB 809, it looks like after 1/1/14 it will be a definitive no adding long guns onto a DROS. Assuming it doesn't get held up in court.
                  www.tenpercentfirearms.com was open from 2005 until 2018. I now own Westside Arms.

                    Cant we all just get along?! lol I have learned a lot in this banter between 10% and Kem. i also asked about this in the centerfire section. My take away from reading some of your previous posts is it is not black or white.....more of a grey tread at you own risk. start a poll.....I'd be interested to know the results.

                      Ask the DOJ, they say no. The CA PC says that it has to be a single sale. loan or transfer. Unless you warp the word single, selling an additional firearm on another day just is not part of "single" and therefore is not legal, no shades of gray.

                      Take a poll on whether a FFL collects sales tax for firearms from out of state businesses and you will find some who don't, but it is quite clear from the CA BOE. So a poll really won't work.

                      If you could get a legal opinion from a well known CA firearms attorney, then you would have something, although if it conflicts with what the CA DOJ says, then what?
