You sold the gun. If you don't pick it up it goes to the PD for destruction. If you pick it up you have his money and the gun. Simple walk away.

I don't recall if we established if on/off roster..

Assuming on-roster he could go re-dros it to himself assuming the "new" FFL will do it. Otherwise, he can try to get the "new" FFL to ship it back to the original one who could DROS it back to him.

Takes time and money, but if on-roster at least he can get it back.

The first FFL sent it to another FFL under the request of the buyer as OP states it.

The buyer (buyer screwed up) is the person who needs to correct this not the seller, any cost is paid by the buyer including money for the sellers time and travel if the seller is so inclined.

Bunyfofu69, if the gun is still the sellers, the FFL is in deep trouble for sending the gun to another FFL without the sellers/owner approval.

Seller completed his contractual obligation. Buyer took control of the gun by having it shipped, even if he didn't get physical possession (which is on him)

Why isn't it the buyers responsibility to have current ffl sell the firearm to recover as much of his cash as possible.

If I were the buyer I would be begging the current FFL to sell it for me to recover my cash. Nowhere did the seller show bad faith.

There was a "implied" contract when buyer exchanged money for the gun and filled out the DROS.

Hopefully this will all work out and both parties will be satisfied.

If I'm the OP, I'll wait for the small claim court and see what the judge have to say. Why shall I waste my time for someone who can't pass DROS?

I have the DROS seller copy.

He's sketchy. He even had the same firearm for sale here without it being in his possession. He deleted it now, but I already screenshot just in case. Caught him in a few other lies. Asked me to pick up gun and just give it to him since he wasnt denied.

Huge red flags. I just want this issue settled so I dont have to ever deal with him again. I even called him to offer him a refund. He refuses to answer. He's scared to talk on the phone because he was talking all lot of crap through text.

He paid mostly in cash and some through zelle from his wife's account. I told him I would refund his wife in person.

Wild.... I never had an issue with another calguner.

Maybe the "new" FFL and him are close thus asking the gun in question to be ship to that "new" FFL. What a winner we have here now, those usually are Armslist deals.

Could we get the buyer's username? I doubt anyone wants to sell or buy with a person asking to give firearms illegally.
