Good evening, sorry I could not get back on here due to other things taking priority.

Ok, first off, no I'm not LE, never said I was. I am a contractor that does prisoner transport.

No, it is NOT required of me to take video proof of why I'm late. Understand, I'm never late getting to work and I don't like being late for work just like anyone else. The last time I was late was almost two years ago only because I got out of my house a little later then I wanted to.

I tried to take just a quick video to prove why I was late getting back to the office. And as some of you who are reasonable and would understand that to cover my being late. I also stated that officers I work with like to milk the clock by taking extra time to get back to the office when it should only take 15 minutes, not an hour or more.

The CHP officer gave me a citation for what I did. Now for some of you rude jerks here that don't get it. When I am working, I'm expected to hold myself to a higher standard. Not verbally abuse prisoners while on a transport or whenever I am in custody of one.

I would expect a CHP officer or any other LEO to do the same. You don't have any much right to stand at someone's window and be a complete Adam Henry and disrespect the person you're talking to or in my case, yelling. I expect ANY LEO to hold themselves to a higher standard as there's no need to...like I said... be an Adam Henry about things.

This CHP officer was so out of line that it literally took me by surprise. Now in my original post, I was merely trying to ask if going down to the CHP office to make a formal complaint would be warranted. But instead, I get jerks here trolling trying to berate me on here and making f***ing fun of it which I didn't appreciate.

That night, the officer was so mad and rude that when I presented him the requested documents, he walks away with my registration only and didn't take the insurance card.

What do I get in the mail today?? I get another ticket for failing to provide the insurance when requested....when it was IN HIS HAND!!

Now does THAT warrant a frigging trip to the CHP office for a complaint?? I would think so. I was gonna just take the original citation and go to court and plead my case and just hope for the best...but now that the officer sent me another citation in the mail for not having insurance when he had such a piss poor attitude, that he forgot to grab my proof of insurance and gives me a cite later on?
What kind of BS is that seriously!

So, for you trolls, does this make a little more sense now what I'm trying to say, instead of being jerks about it....

You admit the violation. Go to court and pray for mercy.

The correct place to address alleged misconduct is with that person’s supervisor, not an internet forum. If your complaint is courtesy, then it’s your choice to complain. If your complaint is the validity of the ticket, that’s what court is for and you’ll simply be told to go to court.

Most chippies I know audio record everything since they don’t have BWC’s. Some even have their own BWC setup.

I'm sorry for all the flamers on this site banging you about holding a phone. I think what you're doing is reasonable and isn't turning you into a dangerous 'distracted driver'.

The cops probably dont like being filmed at accident scenes as much as they dont on all the videos on youtube of people filming arrests.

I would dispute the charge in court. I'd say I had a camera, not a phone in hand, as this particular device was deactivated as a cell phone by removing the SIM (as I'm sure you did), hence it was a camera and not a violation. I'd print out my cellphone call and text record from my service provider as proof. As further proof, I'd bring my pay stub to show I was on duty, traveling to and from duty points I knew well, so wasn't GPSing either. I'd tell judge I specifically photograph traffic delays as validation for late arrivals and that it has been requested by my government office. I'm sure you'd get off.

Regarding how to record these incidents, try one of these weighted cell phone holders that cost $12 on amazon. While your stuck in traffic, drop the phone into it (while it's in your lap and out of sight) then put it on the dashboard to capture said disaster.

Oh leave the poor guy alone. He didnt violate the intent of the law by being a distracted driver, talking or texting on his phone. I hate people who fight for or support improper enforcement of confoluded laws....death by regulation and your stabbing us in the back with it

- here's the deal though..

- there's no need to file a complaint.. if the patrolman is truly a bad egg then things tend to sort themselves out naturally.. ie his own department will detect the problem and assign him to crappy details..

- BUT if you go to court it will be thrown out instantly the moment you show proof

- in life follow the 70/30 rule. Which is have reasonable expectations 70% of the time. Allow 30% for bulloxxx...

Sure. Just follow this guy's advice and lie in court. That's how all the guys in the back of your prison van would do it.

Definitely make the complaint. If not challenged, *****holes like him will just keep doing it. Also, fight it in court. Lastly, get a dash cam.

I work in law enforcement as a non sworn employee. I am an instructor for both federal and state training. I work with officers all day long every day. I teach officers as part of my job. Accident scenes are not a fun place to be standing while traffic is going by. As an ex-volunteer fireman and someone who is frequently on the side of the road during accidents and traffic stops the last thing you want is to get ran over.

OP, you most likely were the next violator to pass the officer right after he was almost ran over by someone with a phone in their hand. The officer had came to the end of his rope and you got what you got. Your actions started everyone down that road.

Eat the first ticket and take the second to court as like has been said before it will get dismissed once you show proof.

Here's a little story that happened to me and how I handled it.....back in the late 80's I was driving logging truck. I was on a freeway in a city and came upon an accident. Traffic was backed up and down to one lane. There was a lone officer directing traffic. It was his scene and he was doing it all himself. Cars were whizzing by him as he motioned for all to go slow. I could see over all the cars and noticed he was having a hard time getting everyone to slow down. I backed out of it and went to an idle in first gear to slow the line of cars down as the officer was yelling at cars. He had to turn around and do something on his left and when he spun around at me he yelled "SLOW DOWN" right at me. I pushed in the clutch and stopped right where he stood and said "hows that" with a big smile on my face. It was at that moment he realized what had happened and that he was all jacked up and did not realize I had been crawling along. He told me thank you and motioned for me to continue. Looking at him in the mirror his whole attitude had changed as he got a second to come back to earth.


Until you have worked a crash on the freeway alone you will never fully understand what it takes. We are all human and we all make mistakes. And for the record I was driving the same truck through a crash scene a few years later and got to looky looing and forgot I had a car in front of me.....that is until I felt him bouncing off my front bumper when I accelerated. And we didn't even have cell phones back then. Point is to pay extra attention in those times and forget about everything but the job at hand...driving safely through the area.

You obviously feel strongly about this encounter, so go ahead and make the complaint. Based on your version of events, the CHP officer and his supervisor will probably have a good laugh over it.

You thought you were special because you carry a gun at work, but found out traffic laws apply to you too. The CHP officer wasn't impressed by the presence of your gun no matter how long you "let it sink in".

Go to court if you think you have a strong case to fight the additional citation regarding insurance. Don't follow the ridiculous advice above and fabricate a story about removing your sim card and a non-existent company requirement to film traffic delays.

Don't be surprised if it doesn't your way in court.
You were cited for distracted driving. You violated the law.
You clearly admitted it. As for your recording it to show as proof at work it holds no weight in court. You are still considered "Distracted Driving". If the phone is in your hand your guilty.

All I hear is a crappy attempt at justifying one’s actions. Give it a rest and stop crying about it. Make a decision. Pay it and go on with your life or make a complaint. Either way, you're paying something. Money or time and money.

There is also a lot of crap advice in here. Go ahead and take that advice if you want to make things more difficult for yourself.

Well, the whole point of this was to ask if it warranted a complaint against an officer who literally took it overboard in his interactions with the public.
Guess there's no point to this.....sorry I even bothered you all with this...
