    Hah, as soon as I started reading I knew who that this was going to involve the CHP. Now, I'm going to make an assumption here that the OP is a detentions deputy. If that is the case, he is a sworn officer, but only a peace officer when on duty. In this incident, was on duty, so the peace officer would exempt him as he was using the cell phone in an official capacity, i.e. documenting the traffic incident that caused him to be delayed. Seems like the CHP was sort of being a jerk. And if you don't think that can happen, we had one down here hook up a fireman in his fire outfit because he wouldn't move his fire truck.

      Based on everything I read, I am not so sure the OP works for a government agency. Sounds to me more like a private contract vendor doing prisoner transportation. "Now I know that's a no no in law enforcement eyes,"
      does not sound like anything any cop I know would ever say.

        Never mind the ticket part of this story, I’m more shocked that you have to record traffic accidents to justify why you’re late to work. That just sounds really weird to me, like your employer just doesn’t trust you.

            - And that firefighter is suing the State and the CHP involved for civil-rights violations

            - the BIG MISTAKE was putting the firefighter in CUFFS

            - WHY would you put an on duty-firefighter in cuffs?!

            - had chp just arrested him and said -- hey, sit in the back of the cruiser for a while it would be different
            - but putting him in cuffs doesnt look good

            - it's an interesting case, the firefighters are pressing forwards to try to establish a new case-law...

              How is that in "official capacity"?

              Is it in his policy that he should take a video of an accident causing him to be late? Doubt it.

                Some people seem to believe that because he works in prisoner transports that he is a sworn LEO, there are many prisoner transport contractors that are not LEO. It is basically like a private prison on wheels, in my career have have seen and dealt with many, some very professional others that well they’ll leave you shaking your head.

                Many of them are based out of state and California’s kinder gentler means of prisoner treatment means nothing to them and yes meeting their time commitments is their number one priority. I’ve seen a guy transported in the back of a pickup truck(with camper shell)chained to a I bolt in the bed of the truck. Seen them dump a guys personal property in a garbage can, they travel throughout the country and only concern is moving the body from point A to point B in the shortest amount of time.

                So yes I can understand the OP’s concern over delays, but that does not excuse him from breaking the law, no matter how many others do it. He would not of had to deal with the ‘mean’ CHP officer if he wasn’t breaking the law.

                A mobile dash cam like others have said is something he needs to invest in.

                  I will tell you how it could be in his official capacity. If he is a sworn detentions or reserve deputy transporting a female prisoner, he has to log in the mileage on his vehicle and the time of his start. If he logs out at the jail for one hour on what should be a thirty minute drive, questions will be raised. Not saying that this is the case here, I'm just telling you what could have been the case.

                    Get a dashcam app for your phone and a suction mount. No need for a separate camera if you don't want to lug around extra stuff.

                    I use OsmAnd DVR on the iPhone. It is a very mature, full featured Dashcam. You can set the lengths of video sections and how many to keep before rolling over. To save one permanently (such as when you roll past an accident) simply touch the screen once.

                    The screen is always dark - nothing to distract you or suck down the battery just to power the screen.

                      I think the OP called it right on the money in his thread title, "Attitude citation". Over the years I had plenty of people who talked themselves out of what I fully intended to be a warning and into a citation. I also recorded all of my contacts so when someone wanted to complain, like this OP, my boss got to hear both sides.
