No damn way a stay can be issued. How is the state suffering harm? The state already had standard capacity magazines before this ruling. So how can something that's already existed for 19 years cause irreparable harm.

Think about it for a second without emotion... it is a fairly simple irreparable harm argument to make and one even 2A friendly judges would give a decent amount of weight.

Further, just because the judge ruled against the DoJ does not mean he absolutely will not issue a stay pending appeal. He has to apply the law regarding the legal standard for a stay pending appeal and not his ruling on the on the merits of the case to protect the applicant should an appeal be successful.

Despite Riflegear's earlier email to me stating they won't sell in CA, I received a shipping confirmation from them this morning. Woo hoo!
