California banned organized militias that run contrary to the officially recognized organized militia/state defense force that exists and reports to the governor. The unorganized militia still exists in California. What is against the law is creating another organized militia outside of the officially recognized state defense force.
The reasoning was, as is the case in many states, is should you be able to build a military force, that does not report to the people through an elected official?
My thought is a private army would be unconstitutional, but a militia reporting in to the Congress, Governor or the like would be constitutional.
The crux of the idea is who controls the militia? If it is not an elected official representing the people, then it's illegal by definition. If you take it to a logical extreme you end up with warlords (as Somalia did) who run organized groups of citizens that do not report to the government in any way. There were similar problems in Kosovo with para-military groups running rampant and the state claiming they had no control over the atrocities. Starting a Militia? NO. Organizing an informal group with a goal of being prepared in case the Militia was ever called up by the Governor, POTUS or Congress, maybe, but there are a plethora of legal land mines in CA were you to do so IMO. Possible? Maybe, but all it would take would be one nut-job associated with such a group to doom you. You would have to vet everyone very very carefully.
You're better off forming Mutual Aid Group / Prepper group of family and friends and then network to other groups formed by close friends and their families. As others have said, that's much more benighn (sp). Disaster preparedness group
You and a few families get together and become informed on how to survive without grocery stores, have a plan in case of natural disaster, are capable of safely operating a firearm, etc.
I don't see anything in the penal code that makes any of that illegal.
What you can't do is form your own military.Comment
