Armed Scholar Miller v. Becerra Decision

Here is a quick update on the Miller v. Becerra Decision just issued by Judge Benitez and the legal side of things by the Armed Scholar. A lot of you will ask me what does this mean, so here is what you need to know.

I guess we don't know who the judges are reviewing stay requests .. I think the 9th circuit hide those judges from us.

They do; I mentioned it in another thread that they decided one day to stop revealing who the judges are. I asked them if they told anybody or announced this decision beforehand, and the clerk was all "Nope!".

The logic behind the decision if one considers it makes sense to a degree: By hiding the judges on the motions panel, this means that lawyers filing motions near the end of the month don't get to "game" the system by deciding that the current motions panel is almost likely hostile and next month's panel might have a chance of being less hostile.

I'd like it if they'd post the previous month's panel every month though for statistical purposes. Given the change in makeup of the 9th Circuit Court of Appeals in theory it should result in some motion panels being 2 Republican nominated judges and 1 Democratic nominated judge, but the motions panel isn't randomly drawn either.

Yeah it seems cool but sadly this is going to do absolutely nothing. Scotus won't take the case, California doesn't care about ethics, or the constitution. Our governor is a one man government. People popping popcorn now are downright delusional.

It is extremely likely that the appeal for this will be held until there is decision in the NY case recently granted cert. They are expecting some guidance from SCOTUS on appropriate levels of scrutiny. If they get that guidance it is likely we win at appeal and no enbanc. Lacking any guidance from SCOTUS any win on appeal will go enbanc like every other win.

One fairly greedy outcome would be that CA doesn't appeal to the 9th because other Democrat states don't want the damage against AW bans to spread to other jurisdictions. While that would be good for Californians it wouldn't help other states looking to have an AW case reach the national level.

Not likely though, all the money and hubris in CA democrats will see to that.
