Help !! Active duty Marine Denied DROS

X2 on this one."....and they call saying I am denied dros."
OK, but did they say why? No - they can't, as they don't even know as to why it's denied. They are not advised as to why.
1) Have you verified the reason with the DOJ/BOF for your denial? It could it be some lesser innocuous issue having nothing to do with your assumption of the case from your past.
2) How far into your 30 days are you at this moment? (Others have had this happen and the issue has resolved itself without the LiveScan, without an answer from the DOJ/BOF within the 30-day time.)
There can be a lot of mundane reasons for a denial...- ID doesn't match address,
- Name spelled wrong/typed in wrong,
- City/Zip Code issue for your residence (which with you being active could pose a host of anomalies),
- The GUN could have a serial number issue/anomaly/mistake,
- The FFL made some other mistake on the DROS entry,
... and more.
Try to get a specific answer as to why you were denied first before going on a wild goose chase.
A couple of other questions, are you a CA resident? I am assuming yes. For your place of residence did you put your home of record, or current duty station? That right there may cause a mismatch. Additionally using FPO AP addresses do not "compute" because they are technically outside California, so that would be another cause for a denial. You really need to #1- figure out why you were denied, and #2 talk to legal office/personal lawyer to get your personal stuff squared away.Comment

Several years ago Veterans were exempt. I called a LGS, told them I was a veteran and what do I need paper wise too bring. They told me, drivers lic.,car registration and a copy of my DD-214. Also I left the copy of my DD-214 for their files.
Went back to buy another pistol about a year later and they told the DD-214 doesn't work any longer. Need a HSC card!sigpic

Actually they can dig up old crap and file. A Marine buddy of mine was involved in a car accident (his car was hit as he made a left turn into a parking lot) but no charges were filed. Basically told it was a wash on both parties faults.
Fast forward about a year and as we went through customs in Alaska upon return from deployment to Japan he was pulled aside. When we got to LAX we were all asked to remain seated and for him to come to the front of the plane. Where he was met by police as he had a warrant out for his arrest due to the prior accident.
The kid who broadsided him (never even slowed down) was the son of a Colonel who apparently pushed the local DA to file charges.Comment

What is even more asinine is that during your 8 active years you are exempt, when you are discharged you are not exempt because you must have forgotten how to safely handle a firearm but if you serve a little longer and retire, your memory is restored and you are exempt again. Once a Soldier/Marine always a Soldier/Marine.Comment

Hey OP, did you use your social security number when you submitted your DROS form? It could be a simple case of identity mix up if you did not use your social security number.Comment

That is in fact the case.
Under the Lautenberg Act, anyone with any domestic violence conviction cannot possess a firearm.
In the Air Force, we have had people discharged due to misdemeanor domestic violence convictions. They become back office trash can emptiers until their discharge paperwork processes. They are considered "Non World Wide deployable" as they can't carry a weapon.sigpic

You had the option to fight a felony charge (which you should have won, if there was no proof of your guilt). My guess is that to save time, trouble and legal fees you plead out to a misdemeanor, as well as to avoid the small but potentially life-altering chance of something going sideways in court if you fought. Some misdemeanors in CA come with a ten year firearm ownership prohibition. This all should have been explained to you by your lawyer at the time if he was any good (i.e. not a "public defender" what a joke, they only exist to rubber-stamp plea deals). Maybe that's the situation or maybe you got probation and an offer to expunge after a certain amount of time. The catch is that they don't automatically wander over to the filing cabinet after the ten years is up and wipe your file, it's still there, you have to process a form to get them to officially remove you from the prohibited status list.Just to clear up I was at the house working on his little brothers truck who is my age when they were raided by the sheriffs. They said since I was on the property I should of known and that they where charging me with cultivation BUT i did not have any marijuana on me or wasnt around it. The judge wanted to drop the whole thing saying "why are you guys bringing up old laundry" but the DA was pushing for something so the judge had to give me something. 11357C is what he gave me even tho there was no pictures or proof I had anything to do with it I was just there. Hate rambling on about this but it seems like some people on here think I deserve the punishment.
Your attorney (got a real one this time?) should be able to get you squared away, or at least filled in on the particulars of your situation. Hope you'll report it back here when you find out so that others can learn from your experience.The one thing worse than defeat is surrender.Comment
