      Just to clear up I was at the house working on his little brothers truck who is my age when they were raided by the sheriffs. They said since I was on the property I should of known and that they where charging me with cultivation BUT i did not have any marijuana on me or wasnt around it. The judge wanted to drop the whole thing saying "why are you guys bringing up old laundry" but the DA was pushing for something so the judge had to give me something. 11357C is what he gave me even tho there was no pictures or proof I had anything to do with it I was just there. Hate rambling on about this but it seems like some people on here think I deserve the punishment.

          You should have fought it. Instead you did what the DA was counting on you doing and copped a plea.

              Usually people with questionable things on file are delayed, not denied. This is merely based on observation.

              I was delayed for a 6 month period when I already had 12 rifles and 2 handguns. My 'questionable' event was an arrest with no charges and I was let go immediately. One day I got a call randomly from the CA DOJ, and was told to fax my DD214.. my delay ended pretty quickly after that.

                Im more interested in this 4million dollar gun...

                Play around with? Your probaly a small arms tech/ weapons custodian. No grunt gets to play with a $4 million gun everyday unless the went to STA/Recon/MARSOC. And thats still not everyday...

                        That doesn't make sense and its not how the legal system works.. The DA wouldn't file unless the Det can show you met the elements of the crime, a DA doesnt just dig up old crap, the judge doesnt HAVE to give you anything

                            Are you sure of the reason for denial?

                            The 11357(c) conviction is a straight misdemeanor and is non-disqualifying. If that information is accurately contained on your DOJ record, there should not have been any problem.

                            On the other hand, if there was information on the DOJ record showing that you were under indictment, or information, for a felony charge (remember, you said that it started out that way), then that would send up all sorts of red flags. In fact, if you tried to purchase a firearm with felony charges pending, that would have been a felony.

                            DOJ records are very poorly maintained, and the main problem is that records are not updated to show court dispositions in a timely or complete manner. This is pretty well-known to everyone, and the corresponding red flag usually takes the form of a delay until the record is updated.

                            The FBI isn't going to anything to help on this one. I'd recommend that you check with the clerk of the court where your conviction occurred and confirm that the information was transmitted to DOJ.

                              You're in contact with lawyers, right? The forum isn't going to be able to help you. What you can do is keep posting and then end up providing information for the state since this forum is known to be monitored, but that would be a silly idea. Quit posting about it.
