    Help !! Active duty Marine Denied DROS

    So long story short back in 2011 I was at a friends house and its a 40 acre ranch, His brother got raided for growing weed they let me go because I was going to bootcamp the next week.

    2 1/2 years later DA picks the case up after I have been an active duty Marine for that time and have never been in trouble. Starts off as a felony and they drop to misdomener. 11357C having over 28.5 grams.

    I pay the fine deploy on a combat deployment go try to get 3 lowers from Faith Armory in Temecula because they where having an awesome sale and they call saying I am denied dros.

    I have a Secret Clearance and play with a gun thats worth about 4 million on a daily basis but cant own an AR? I have appealed the case thru online but think to clear it up im gona have to do livescan and wait the insane time they say it takes to verify. Has anyone ever gone to the FBI satallite office in carlsbad and tried to clear this situation up ? or do I have to mail it and wait that time? Any input helps freaking out a little

      That sucks dude. The government just loves to overstep it's bounds. I don't have any advice to offer, but that just sucks and I feel for you.

      How long do they say the livescan takes to verify? Sadly giving people back their rights is not really high priority for the PD, DOJ, whatever. They'll take your rights away in the blink of an eye for any reason but they don't give them back easy and you usually have to fight for it. Have you talked to an attorney yet?

        Yes contacted CalGuns lawyer but he said wait until we see my record they probably messed up somewhere. I just dont get how I can clean my personal m9 and saw everyweek but cant own an AR. I misread the livescan time frame it says anywhere from 2-3 day up to 2 weeks. Faith Armory is working with me holding the lowers but if this drags out wonder if they will keep them for me since I have already payed them. There is no way I can be in the military and cant own a weapon is there? thanks for the responses guys

          Yeah this state can be that stupid. Sensible call on contacting calguns, but don't post anymore details online in the event it actually does turn into a legal issue.

                  I would like help on fixing this not running away to another state thanks for your input tho. I am not PCSING anytime soon so want to figure this out.

                    He may come up prohibited in an out of state NICS check too. I would stick it out and clear it up. Hope it works out for you.

                        OK, but did they say why? No - they can't, as they don't even know as to why it's denied. They are not advised as to why.

                        1) Have you verified the reason with the DOJ/BOF for your denial? It could it be some lesser innocuous issue having nothing to do with your assumption of the case from your past.

                        2) How far into your 30 days are you at this moment? (Others have had this happen and the issue has resolved itself without the LiveScan, without an answer from the DOJ/BOF within the 30-day time.)

                        There can be a lot of mundane reasons for a denial...
                        • ID doesn't match address,
                        • Name spelled wrong/typed in wrong,
                        • City/Zip Code issue for your residence (which with you being active could pose a host of anomalies),
                        • The GUN could have a serial number issue/anomaly/mistake,
                        • The FFL made some other mistake on the DROS entry,

                        ... and more.

                        Try to get a specific answer as to why you were denied first before going on a wild goose chase.

                            OP, you should have spent the money to fight the original charge. Lack of a speedy trial might have been one way.

                              Get 3 80% instead. I feel for you, active military is exempted from the hand gun safety card, soon as your out, the state assumes that you forget all the safety rules.
