    Roomate might be a felon.

    I am going to be moving into my friends house and one of the rooms he rents i have a very high suspicion that he might be a felon. I own 2 firearms and am unclear what the law is. I have them trigger locked but am going to fork out money for a wall safe in the 300 dollar range just as another barrier of protection.

    My main concern is if I am breaking any laws by having them in the room I will be renting. Like I said I am not sure if he is a felon but I believe he is and obviously don't want to ask him if I don't need to.

    On a side note I would like to say hello since this is my first post.

    You could always just ask him... honesty between roomates is generally a good thing

      As awkward as it might be, it's a wise move to ask him. If you do it in a friendly, non-judgmental and non-confrontational manner you shouldn't have a problem either. If he isn't, no harm done except a little embarrassment, but if he is you'll have a better idea of what you're getting yourself into by moving into the new place.
      Legally speaking, I think you're ok if the firearms are locked in your room, and the trigger locks certainly won't hurt. I'm not sure what the law is regarding felons and firearms access, but no matter what a decent safe is a good investment.

        If he is a felon,it really depends on his P.O., porole/probation conditions and his crime. I don't think you will get in any trouble,it's up to him to stay away from any compromising situations.

            Just remember the following:

            If he lies, tells you he is not a felon, you carelessly leave a gun out of the safe and he gets raided by the cops, they will take your gun - no I'm not joking, we had someone on here not long ago this actually happened to. The gun is now evidence in a crime, even though the felon never laid a hand on the gun he was a "felon in possession of a gun" because he had access to it in the home i.e. it was not locked up out of his control. So you could end up screwing yourself out of a nice gun and the roomie gets a gun charge in addition to whatever made them come looking for him in the first place.

            Second:
            You want to lay down and sleep with a felon in the next room? You want to leave all your stuff, unattended all day while you're at work, with a known felon on the premises? I would think there would be better rooms for rent in the area where you don't have to live with lawbreakers.

              two of the better people i have meet in life turned out to be felons. some just made stupid mistakes early on in life and seriously have changed. take him aside and talk to him about it if you have concerns but dont judge a book by its covers.

              of course if he or anyone else turns out to be shady then i say dont move in (felon or not)

                Do you know this guy or any of is friends? What type of people does he hang out with? If you have doubts just don't do it - having peace of mind is much better.

                  As far as I know if the gun is in your locked room, then you have nothing to worry about, legally speaking...

                    I remember that the law stating that they would require you to lock the gun up in accordance to the shaking wording that all california laws have. That if the felon claims you left it out or gave it to him to reduce his theft charge, it'll put you into hot water.

                    If you don't know hes a felon though. Then the legal ramifications can be a little more safer.

                      It sounds as though you are going to move in regardless of his answer. Is that correct? If so, and if you are going to buy a safe & have the guns trigger locked, I wouldn't ask him anything. Again, if moving in is a done deal and you ask and something happens - as in he gets his hands on your guns and bad things happen - what have you accomplished except establish that you knew in advance that he was a felon and still chose to introduce guns into the environment. You put cheap rent and your selfish desire for guns ahead of the safety of the cherubic little girl and police officer he shot after he stole your guns & went on a meth binge. At least that's what a DA or civil attorney might postulate - that you should have forseen what happened and are partly responsible. I'm just winging it on the last part of course, maybe someone with real legal knowledge can chime in.

                            Two of my friends (they are brothers), lived together. The older one has a felonly conviction, the younger brother rented a room from him. The P/O officer told him as long as they are locked (lock on door also) up in the room that the younger brother rents, then everything is ok. Every time he was gone, he had to have the door closed and locked to the room.

                              That's true - I agree 100% and I'm not judging. He could be a great guy who swiped one box of cigarettes 10 years ago or bounced a few checks. But if our OP is definitely moving in, what does he gain by asking? If the guy (felon) is an OK guy, then no harm - right? But if he asks and the guy says he beat the hell out of someone last year then took the cops on a car chase through the city - what's the OP supposed to do if he's still committed to moving in?

                              Now if the OP says "depending on the answer I may not move in - or I may move in but stash my guns someplace else" I'd say ask away. But if he's definitely moving in and he's definitely keeping his guns, what's to gain by asking?
