    Divorce - PSP held hostage

    Well, my friend is getting a (getting messy) divorce. he just called me and told me that the case with his HK P7 PSP is missing as well as his passport. His wife seems to have taken it last saturday and is now holding it hostage for more of his $$. It was purchased long before they were married and I do not believe it's divisible property.

    he's thinking of reporting it stolen if it isn't returned tomorrow when she comes by to pick her stuff up. Do you guys know of any ramifications of him doing so? Any other suggestions as to a course of action?

    I'm not really sure what I'd do, but don't you think the title of this thread should be, "Divorce- passport held hostage?" I'd think that would be a little more important than a PSP. And I'm sure a PSP is worth a lot less than however much money the wife wants.

        I would agree that the passport is the more signifigant item. Unless he can prove the PSP was purchased prior to marriage, she can easily argue its community property.

        How much more money can she expect to get out of him for the PSP? One can be purchased brand new for under $200.00????

          Sorry, i should be more clear. PSP as in HK P7 PSP, not the Sony PSP.. lol

              The P7 was purchased under his name so he can file a police report to get it back.

                  Well if it's going the ugly route, its only going to get worse. I hope he has his locks changed. She should not be allowed back into the house or other things will disappear. My response would be to put up all her stuff on ebay, or garage sale it for the cash to replace items that disappeared.

                    He should talk to his lawyer about his options. Anything and everything he does from this point on will have legal ramifications.

                      I'd suggest he be the one to file first AND get a TRO along with filing a stolen weapon report. The passport can be replaced. If he has other weapons in the house->lose them quickly. Hopefully he has the receipt for the PSP handy and should take a copy of it when filing a report.

                        I"d be careful about escalating the situation too much, what you don't want to have happen is a TRO be filed against your friend. Without accusing her your friend needs to let her know his passport and pistol are missing, and that he will be filing a police report on it.

                        He should not ever meet with her alone or lose his temper with her, or make any threats. Let their lawyers work out the settlement.

                        In the big picture losing one firearm in a divorce isn't the end of the world compared to losing your right to own firearms for 10 years.

                            He may need to file a stolen handgun report to comply with local ordinances. When doing so, he should identify the likely suspect.

                            The stolen passport is federal property.

                            The "ex" really isn't very smart...

                              I think technically since he is still married on paper the items are not stolen property since his wife has them. Getting them back is a civil matter and not a police matter. I've been going through the big D for almost 2 years and I have made all my firearms disappear till it's over with. Less ammo for her to try and make complaints against me with. I'd suggest your friend do the same if he gets the gun back. I'm assuming your buddy has an attorney, right? If so just let the attorny's settle everything out. The gun and it's value can always be replaced. My ex tried that crap with me as a way to irritate me and get me to do something to her so she could then use my actions against me. I suggest that when she does go to pick-up items call the local PD and request an officer/deputy to be there to "keep the peace" before he opens the door or let her take anything. That is a 100% effective way to make sure nothing bad happens and she doesn't make up false claims about him.
