His wife seems to have taken it last saturday and is now holding it hostage for more of his $$. It was purchased long before they were married and I do not believe it's divisible property.

he's thinking of reporting it stolen if it isn't returned tomorrow when she comes by to pick her stuff up. Do you guys know of any ramifications of him doing so? Any other suggestions as to a course of action?

    TIA
Easy answer. He needs to talk to his lawyer.. period end of story.

Purely Academic, if she does not have an HSC or other exception is there a legal ramification for her?

Messy divorce. Wife steals passport and handgun. He needs to file a TRO, FAST. He IS fearing for his life isn't he? She's angry, armed with a stolen handgun and has his passport. If he's not at all "afraid" of her possible motives or potential actions, he's stupid.

Sorry, i was at work, and all forums are blocked. He's trying to settle things calmly. It seems either her new bf or her sister warned her about the passport thing and she's mailing it back. He asked her if she'd seen the PSP and she said she "might have taken it by mistake" when he casually mentioned filing a police report. It was purchase back in the 90's (low 4 digit serial, w/ box and papers).

The money thing, well, i told him to get a lawyer. Thanks all, ill pass on the info.

I assume TRO means temp restraining order?

Don't ever mess with the passport. My wife and I got into an arguement about 12 years ago and she ripped up my passport. When I went to renew it and turned in the pieces, they gave her the riot act for destruction of government property. Fortunately, they let it go, but they kept pushing me to pursue charges.

The Feds don't like it when people mess with their stuff.

The problem is that SHE is not. She is looking out for herself and nobody else. If she can screw him over in the process all the better. She is not going to suddenly "wise up". Get him to a lawyer and let the lawyer deal with the ex. If she starts to act like she is being reasonable run away. It is a setup. Reasonable people will act reasonably about this stuff from the beginning.

Your buddy "trying to settle things calmly" might end up sitting in a jail cell because she decided he looked at her wrong. I have a crazy ex wife, the only reason *I* wasn't sitting in a jail cell was that she tried her crazy story on a friend who told her that she was full of crap first.

Tell your friend to not be alone with her under any circumstances and get a lawyer.
