apparently alot of folks here seem to think that building a ar15 rifle and building a ar15 Pistolis the same thing. it is not. you must abide by all california and federal laws pertaining to manufacturing a pistol. safe handgun roster is the killer here. because there are no ar15 pistols on the safe handgun roster, and a stripped ar reciever cannot be drosed as a pistol because it does not meet the safe handgun requirements, you cannot build an ar15 pistol from a stripped lower reciever. the penal codes that rick cited govern all pistols manufactured and sold in the state of california. this is why you dont see bare glock gen 4 pistol frames on the market. doj will not let you dros and register an incomplete pistol because it does not meet california safe handgun requirements.

So wait you are a LEO ? if so that changes everything . you as a LEO can have the ar lower dros to you as other/pistol because you are exempt if im not mistakenOk now I'm confused. Lets start from the beginning and maybe you can clear some things up for me:
I bought an AR 15 Lower Receiver brand new, never used from a licensed shop. I bought it for the purpose of building an AR 15 Pistol. At the time I purchased it I was told by the clerk, who I trust, that I could as long as I registered it like a handgun once it was built. The clerk knows I'm an LEO.
As I started buying the parts I became nervous in that I wasn't sure I was going to get the thing built before any bans so I called up the shop and talked to another clerk, who I trust and knows I'm an LEO. I asked him what steps I needed to do to get the pistol registered once I finished the build. At this point he told me that I couldn't build an AR Pistol from the lower I had bought. He said there are only 2 ways to legally own an AR 15 Pistol, one, I can buy a complete AR Pistol from a dealer or two, I can build one from an 80% lower.
That's when I went to AR15.com and here for advise. Now, based on all the feedback, which I do really appreciate, I'm somewhat perplexed as to what my next move will be with respect to getting this thing built.

leo's are not exempt from manufacturing laws. buying a off roster pistol vs. building an off roster pistol are very different things. and leo's are only exempt from one of thoseComment

how would it be manufacturing tho? hes buying a completed ar lower hense its already manufactured right? im not trying to argue with ya just trying to figure this out

no its not. bare recievers do not meet ca-doj definition of pistol, it needs barrel length and caiber. so he still has to continue the manufacture process untill it meets ca-doj definition.

cali's laws are soo *** backwards you cant tell whats legal and whats not.

The main thing is what the lower gets papered as upon sale and him being LEO they can check the pistol box on the dros form , he then can assemble it in any legal pistol config. without running afoul with the law .

It is not the fact that you put a rifle barrel on the receiver that is an issue, it is whether you put a buttstock on it that matters. There are no laws, federal or state, against building an LBP (long barrel pistol), and no laws against then putting a short barrel back on it.Comment

This is not true. They are not DROS'd as rifles. They are not DROS'd as pistols, but that is not the same thing as saying it is a rifle.Here's my take.
AR lower receivers sold at stores are only drossed as rifle. A lower receiver cannot be drossed as pistol receiver since it doesn't meet the California safe handgun laws. This is a Cali thing. On a federal level, I think it is okay to buy from an ffl a lower drossed as pistol.
From a federal point of view, it is legal to take any virgin receiver: 80% finished by you or 100% purchased, and build it as anything.
When I say a virgin receiver, that means that it was never built into a complete rifle and bought that way (4473 saying it was a rifle, or some other form of completed long gun), or even attaching a buttstock in your basement.Comment

The reason you do not see bare glock receivers on the market is that glock does not sell them. You cannot buy them anywhere as new. The only way they could be on the market as new is if somebody slipped them out of the glock factory. This is true. But, it would be more correct to say that it does not meet the statutory definition of a pistol, or a rifle or other type of "long gun", for that matter. The DOJ opinion is not relevant.
ETA: I am assuming we are talking about a virgin receiver. One that has never had any parts added to it.Comment

I think you may be right, today a knowledgeable friend of mine told me that according to the DOJ, I could build an AR Pistol from a virgin lower if once I complete the CA legal (BB & Single shot) pistol I take it in to get DROS'd as a pistol. They will hold my pistol for 30 days.
