Got a call from a FFL today

A couple weeks ago I found a hand gun in the classifieds and made arrangements to do the PPT at the seller's favorite FFL, which is about 50-60 minutes from me. It seems like every deal I do is about 50-60 minutes away, but I'm retired and have a beater car that gets great gas mileage so I don't mind.

The PPT was smooth and easy on day one and I even got to shoot a few rounds since the FFL is also a range. The ten days pass and I return to do the pick up.

During the pick up process the lady handling it seemed distracted by some sort of recent arm injury. She couldn't operate the slide because of stitches in her arm. After I signed my name I asked her what the date was. Being retired I often lose track of the date. She said it was the 8th so I wrote that on the form. Finally we were done and I was on my way.

Today the shop called me and told me I put the wrong date on the form. The real date was the 6th and not the 8th. They asked me to come in sometime today and change it. I told him I got the date from his employee and they were nearly an hour away. I suggested they just change the date. He said they can't legally do that. Then he suggested I just stop in next time I'm over that way. I said I would, but that was my first time over the Ortegas in two years, so it might be awhile.

He insisted that I alone had to change the date, but he really didn't tell me if there is a penalty if I don't.

Do I need to make a special trip over there to correct this? He did offer to hook me up with free range time, but that's not really worth the gas/drive time to me. It was worth two trips before because I got a great deal on a gun.

    Thoughts?

Shops are anal about everything being perfect on the paperwork. I once spelled my street name wrong and the shop made me cross it out and write it correctly and initial it. Im assuming their just covering their a**!!! But to drive an hour to change the date is a little much.

      It's their mistake.

Tell them either a $50 gift card or they drive to your place with the paperwork for the correction.

      Retired or not....time is money!

Its a hard one, I can never remember the date but I don't expect any one else to sense a can't so I check my phone. I don't think it's The employs responsibility to know the date for a form you are filling out.

But if I was in your shoes I would be annoyed and tell them " I'll see you when I see you"

Man you have bad luck when it comes to purchasing firearms..

If this is the shop that also sold you the threaded S&W M&P 22 you need to find a new FFL...

If he never goes there and wasn't there for two years, I am deducing it was not the same shop. However, go easy on shops that sell threaded M&P22s, some wholesalers weren't real clear on that in the early days. I might have even know a shop that did the same thing!

There is no requirement you go back out there. Although it might technically be correct that you have to fix it, no auditor would ever know it was them that corrected it and initialed it (even though technically you have to create a new 4473 and attach that copy to the one you need to fix). So if they want you to cross it out and correct it, that is technically not correct.

They are 100% at your mercy. Considering that is not worth your time, I would ask them to pay you in advance via check the going mileage rate to go fix it. Their other option is to mail you the 4473, have you fix it, and then send it back in a postage paid envelope.

I would call them back and just be honest and pleasant with them. Something like this.

"I understand you are trying to do your best to stay in business, but I am under zero obligation to come back and fix your mistake. I want to help you, but you are simply way too far out of my way to justify driving there to help you out. I wouldn't mind doing it if you paid me and I also wouldn't mind you sending it to me via mail and I can return it that way if you wish. However, the reality is I am not going to come back out there just to fix this. What would you like to do for me?"

If they threaten to call the ATF or any law enforcement, then they have stopped being friendly and then I would just refer them to your lawyer and bid them adieu.

You put the wrong date not them. Even though you needed to ask her the date, and she was wrong, it was your responsibility to put the correct information - not rely on someone else who is not signing your name to it. So, do the right thing and fix your mistake.

If they insist that you change it, they can either pay for your time and expenses or drive it to you to change. It's their choice. In either case, they should also pony up some sort of "thank you" for your troubles.

                      It's not their mistake.

When you are asked to sign something

Either make sure it's correct, or don't sign it.

I'd chalk this one up to experience. I doubt you will let that happen again.

Now, if they offer to make it right somehow, great

It would be good for business

But the bottom line is that it is your responsibility

Shop should have looked over your paperwork to double check to avoid just this.

Sucks man. Hope it all works out.

                          This is the correct answer.

Not really, it is the shops responsibility to ensure the paperwork is filled out correctly before you leave. You are the customer, they are the business and ultimately it is their responsibility to ensure the paperwork is done correctly to avoid this.

This is NOT the shop that sold me the evil S&W M&P .22. I only went to this shop because the seller picked it. After 8 or 9 transactions from the classifieds I have found meeting where the the seller wants usually works best.

The shop that sold me the .22 is local to me.

I have found a new FFL for my personal use - Counter Strike Firearms in Hemet. But when I buy from the classifieds I can't insisted we use my FFL.

12 gun purchases since I started expressing my 2nd Amendment Rights in March. Two problems so far - the .22 and this glitch. Is that a high error rate?
