CGF will get the AR back no doubt, but what if it's all jacked up? Do you spend $5k to sue for damages for a $2k AR? You see what I mean? Too much drama to go through.

OP, did you even have the flowchart or the SAC PD memo to show?

Say CGF does step in and take care of the situation. What financial obligations does the OP owe to CGF if any? Just curious.

Donate at least 20% of the total cost of the rifle to CGF.

Were you carrying lead ammo while hunting in a condor zone? hmmm

Seriously though, all my dealings with DFG have been fair. Where I hunt they all seem to know about black rifles and are more out to get poachers and illegal pot growers than anything.

It's almost like they're purposely not arresting because they know that an arrest requires alot more justification, paperwork and scutiny. So to avoid the scutiny they just take the gun. But if someone is truly in felony posession of an unregistered AW, I think there needs to be some forced scutiny on why they would confiscate the gun but not make the felony arrest.

Almost just seems like a gun grab in hopes the guy will not be willing to deal with the hassle to get it back. Perhaps some costly litigation will be needed at some point to stop this seeming abuse of authority.

I really would like an explanation over this confiscation w/o arrest question. It's almost like they know it's gonna be a stretch to make an AW charge stick, so to avoid that scrutiny they just confiscate which in essence keeps that matter "in house" within the Dept. rather then having it actually go to court and be scrutinized by a judge.

If they just confiscate then it essentially becomes a matter of ones attorney having to deal with the Dept. where procedures are less defined vs. the courts where that are more strict rules.
Exactly, If you are arrested for doing absolutely nothing illegal and falsely imprisoned you can sue for a violation of your civil rights. They know this, and are not really sure if it's an AW or not so they just take the gun and figure it out later (at your time and expense). Now post McDonald vs Chicago would it not be a civil rights violation to be stripped of your means of self defense for no reason? This has to stop, and it seems no matter how much "education" some people still don't get it. As a citizen, ignorance of the law is not a defense. As a LEO, ignorance of the law is indefensible.

Contrary to the belief that the OP should have been arrested, that is not necessarily true. An LEO is not required to make an arrest for any crime up to and including murder. Arrests are made mainly due to concerns for public safety and by department protocols.

So bottom line, what are ya supposed to do in a similar circumstance?

I've found trying to prove that the LEO is wrong (arguing?) doesn't solve anything. In fact it seems to infuriate them into enforcing their authority even more.

Pretty much. If the LEO isn't informed, you, a civi, aren't going to be the one to change their mind right there on the scene.
If I was in the OPs shoes, first thing I would do is get a hold of Oaklander and Ohsmily for a dream team legal defense. But that is just me.

Hmm yeah yzernie has a point there.

Hope it was just a non informed Ranger w/Biology degrees up the ying yang due ot credential inflation (Hence the mistaken ID). And the OP most likely gets his AR back. Soon.
