Because reporting it lost or stolen at this point could easily be viewed as filing a false police report. He gave the gun to the dealer/gunsmith to do work. The dealer didn't steal them and the OP doesn't have information that the dealer lost or sold them.. The dealer is not completing it in a timely fashion and according to OP avoids calls, etc. There is no record (yet) of a demand for the items back (hence the suggestion to put into writing the demand for return of the property in support of a claim of theft by conversion if they refuse to return it at that point; still will likely he viewed as a civil matter)...also, bringing cops into a situation involving firearms should be avoided unless absolutely necessary.Aren’t you supposed to report firearms that are missing? I’d just say the business owner lost/stole my firearm. Create a paper trail if it ends up in wrong hands.
I had a mailbox break in recently and was told by my neighbor I should file a police report. I gave it a shot and they actually came out to inspect it and provided a case number. We got to chatting and I found out since it involved a federal crime they had to come out. So they do come out in certain cases, this being one.
EDITED TO ADD: If the FFL is expired, ATF may he more interested in the disposition of firearms which should have been in this FFL's A&D book...they don't like unaccounted for guns.Last edited by ohsmily; 11-23-2021, 3:57 AM.Expert firearms attorney: https://www.rwslaw.com/team/adam-j-richards/
