OP, is he a CA or AZ resident? How would you have PPTed a gun from a AZ resident here in CA? Looks like he's a repo man based on his FB page. Is he a CG member?

Can you get his info and sue him in small claims court?
Rule 1- ALL GUNS ARE ALWAYS LOADED

Rule 2 -NEVER LET THE MUZZLE COVER ANYTHING YOU ARE NOT PREPARED TO DESTROY (including your hands and legs)

Rule 3 -KEEP YOUR FINGER OFF THE TRIGGER UNTIL YOUR SIGHTS ARE ON THE TARGET

Rule 4 -BE SURE OF YOUR TARGET AND WHAT IS BEYOND IT

Lets get a few legalities out of the way. According to your post as written. Both you and the seller were breaking a number of state and Federal laws. By conducting an across state line transaction of a firearm between residents of different states.

To be legal, the Az resident would have to deliver the firearm to a Ca State FFL. Who would then do the Ca DROS, and a Federal 4473 to legally make the transfer to you.

Which would also bring the Ca State Roster of Safe handguns into consideration.

You made several common sense goofs that the seller took advantage of at your expense. Yes, that is fraud. But would require a civil remedy. Cops are likely never going to even investigate it.

Sorry you got screwed. Arm yourself with knowledge before giving anyone money as a deposit again.

Good to publish the incident and the lowlife's information as a warning to others.
I hope you collect from this slimey creep.
He apparently knows you are after him as he blocked your number and took down facebook.

How much was the deposit? Call it a paid lesson. Hopefully you got some street smarts out of the deal. A lot of people have paid way more to learn the same lesson.

Almost everything about this deal is WTF.

Sorry, let me make it clear, I made the deposit to make sure that the seller would not sell the gun to anyone else since by the time he was still a AZ resident and he said he was waiting for his CA ID, and yes all the transaction must be done at FFL dealer NO exception. I got pretty much all of his information, and I wanted to sue him as a small claim but as I mentioned, the court will dismiss my case if I don't have the exact location of the person I want to sue
I gave him the deposit in the resident where he said it was the house he just moved in, and I stopped by couple times, but never seen him again. The neighbor said he left back to AZ or something.
I should of keep half of the gun with me :/

you need to research internet fraud. but if they catch him, you will have to go to AZ to prosecute him so they can convict him and make him pay you back your money.
Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.
I really miss the good old Pomona Gun Shows.

If they can find him, I dont mind to see him in AZ court since I go to AZ to visit my friend often.

How did you and him come to the term that you had to make a deposit?

                            Was the deposit a lot?

                            Sorry to hear that OP.

The gun was listed for a very good price, and I dont want to miss it, so I decided to give him the deposit to secure it, and it was $400
                              Thanks, Benji
